As far as I know the theory that if you only consent to sex on the basis that it's done with a condom and then the condom is deliberately removed then that is ra pe hasn't been tested in an English court.

Until recently it certainly wouldn't have been ra pe as consent obtained by deception was only ra pe if there was deception as to the ID of the person you were having sex with or as to the nature of the act (eg it was said to be a medical examination).

Other deceptions were not historically ra pe and lying about wearing a condom was seen as similar to lying about not being married. It may well be that in either case the other person wouldn't have had sex had they known the truth, but that didn't make it r ape.

However, the law is clearly moving towards the view that deliberately removing a condom without consent is ra pe and I suspect if such a case gets to court these dates it would be found to be ra pe.

However, the problem with getting a case to court would be evidential. Condoms do break and do slip off and do doubt anyone accused of rap e in those circumstances would say it was an accident and it would be difficult prove beyond reasonable doubt it wasnt.

As I say, the situation in the country isn't clear, but I think it likely that if a case got to court and it it could be proven that a condom was deliberately removed without consent then it would be classed as ra pe.

However, there would be huge difficulties proving the deliberate aspect.

Sex is an intimate act and requires trust, so to take off a condom half way through is a betrayal and completely and utterly immoral, AND illegal. There was a case of a prostitute and her client removed his condom. He was convicted of the offence. It was a bit more that just that, but it is down to 'conditional consent'.

First time I had sex (it was a while back) the condom came off, but that has never happened since. I have improved

As I say, the situation in the country isn't clear, but I think it likely that if a case got to court and it it could be proven that a condom was deliberately removed without consent then it would be classed as ra pe.

Sadly the proportion of non stealth prosecutions in the UK is fisgustingly low, meaning that actual convictions represent just a tiny number of the likely real crimes. Whether a stealthing r@,p ever proceeded, due to it being less certain to gain a conviction, is worringly uncertain. Punishments need to be likely to potentially be a deterrent

And therein lies the problem with acquiring conviction for many sexual offences. How do you prove someone did not consent if the sexual activity was at least consensual to start with? It's presumably very difficult and that is very unfortunate.
