Just to let you know...

February 1, 2024. The new law, Section 188 of the Online Safety Act 2023, introduces an offence into the existing Sexual Offences Act 2003, meaning that it is now illegal to share intimate photographs or films without consent.

I think regarding the law, it would be the consent that plays the biggest part. So if you put a photo of your dick on your profile, then that's fine. It's our choice to view it or not.

However if you are sending a photo of your dick to someone in a message without consent. Then that's breaking the law.

Atleast that's what I think it means.

Although technically yes it could be seen as illegal there is no way CPS would entertain prosecuting someone on this or any sex related platform unless the person was blocked and then further harassed them. But it would be the harassment that would catch the charges not the initial unsolicited image itself, that would, unlike someone doing it on a regular social media platform, where you'll see them being charged for the unsolicited pic itself.

Exactly this! And the CPS would prosecute as the mere act of sending an "obscene communication" would satisfy the prosecution threshold. The law is clear. I highly doubt that the nature of the site would be accepted as mitigating circumstances!

To be honest, it isn't difficult to ask for a dick pic or offer to send one prior to actually sending it! That little moment of stopping and thinking first could well prevent you from getting your name on a not-so-exclusive list!

Yes it would be unsolicited if it hasn't been asked for but they get sent anyway. Often if a conversation isn't going well a dick pic gets sent as they think it will turn things around which is naive at best.

This post is very telling that a lot of people need to remind themselves of what consent means... unsolicited is not consent, it's a boundary that's too regularly crossed because people don't read bios or can't think with their big head once the little one goes hard.

The Sexual Offences Act 2003, s 66(a) states that it is an offence where someone intentionally sends or gives someone else a photograph or film of anybody’s genitals if they do so either with the intention of that person seeing it and being caused alarm, distress or humiliation.

The context is key here. I think if you sent something like this "randomly" yes.

Is that applicable on a site like this; then that's a mute point. You'd have to prove the person sending it meant to cause alarm etc on a swinging or sexual content site!

On a site of this nature, consent is key. Anyone who struggles with the concept consent by sending unsolicited genital pics direct to inboxes (women do it too) is screaming very hysterically that they do not know what they are doing in the bedroom or out of it.

Same with the vehement arguments that this is a sex site or that profile pictures suggest that dick pics are wanted....

If someone wants to see dick pics (and many do) they will state that they want to see dick pics. Yes this involves reading and seeing people as individuals.. much easier to apply a blanket approach I guess

The contention that being on a 'sex site' (if that's what Fab is described as) gives implied consent to receiving sexual images, would not be regarded as a sufficient defence, as implied consent cannot be given. It might be argued that there is a case for mitigation when deciding any penalty. The issue potentially becomes even more acute if the receiving party states that they do not want to receive them.

Be careful folks - the Fab Police are watching!

It would boil down to was consent given as unsolicited would mean it wasn't . I wouldn't like to be on the receiving end in court
