Jaffa cake ?

Ok so what are people's thoughts on Jaffa cakes are they cakes or biscuits ?? I know they are called cakes but are often found with the biscuits in the supermarket

There cakes they don't have to pay biscuit tax and biscuits go soft if you leave them out but cake goes hard
