They are using powers that already exist under the Licensing Scotland Act. They will also be reported to their relevant licensing authority for further action. Then I have to question why they are wasting time with emergency legislation if current legislation covers it. " The current legislation only allows for an establishment to be shut for 24 hours maximum, although it can be reapplied repeatedly. " I believe that's to enforce longer term closures, the police already have the power to close them for 24 hours at a time. | |||

" Well the emergency closure orders are likely (I’m surmising, I have no info source) to only cover licenced premises. The new legislation would cover things like coffee shops, or anywhere else who do not serve alcohol. The other interesting thing is what kind of a view licensing boards will take, when the pubs licence is up for renewal | |||
