Certain lockdown measures in Austria ruled to be unconstitutional

The courts responsible for constitutional rights in Austria have ruled that certain measures taken to prevent the spread of Covid 19 are unconstitutional.

The ban/closures of the hotel and catering industry has been deemed unconstitutional.

The ban on events with more than 10 people was deemed unconstitutional.

The wearing of face coverings in public in indoor settings was deemed unconstitutional.

The ruling judge stated there was not enough supporting evidence to put these measures in place.

Hence putting in place these measures was illegal and culpable. The Austrian state may very well be liable for damages according to Dr. Michael Brunner, solicitor in interview.

It may be deemed unconstitutional but I doubt it will passed by the Austrian Courts.

They also ruled that ANPR was unconstitutional last year as well.

The curfew on bars and restaurants in Germany was suspended by a Berlin court as it was judged to be ineffectual.

Yet in Bavaria, the mayor wants to remove the sanctity/privacy of the home...and he is not alone in wanting to bring in those kind of measures.

But what's acceptable/ okay in Austrian law is utterly irrelevant to UK law. We don't even have a written constitution.

I am not familiar with the UK law or your constitution, or lack thereof.

I live in Ireland, so am more familiar with the laws and constitution here. I am merely taking an interest in what goes on.

There was no mention of me wanting to open anything up in my post. I merely stated a ruling being made in Austria on some of the measures taken there.

What happens on your turf is up to your government. I live in Ireland, and therefore follow the rules, guidelines and legislation put in place in Ireland.
