I am lucky to have a job that is not directly been impacted by covid-19

I have been working from home putting more hours in then I get paid to. Work 2 weeks ago announced that the the additional optional day that we have holiday will not be given due to covid-19 this year

However for me that is an issue - I joined my current company on a tupe arrangement which means I had 26 days. The current jobs company appeared to think that 25 plus one extra day = 26 days

I have raised this as now I feel they are in breach of my tupe arrangement. I had even sent a copy of my contract stating 26 days. I have raised it as an issue and now having to resort to my union because of this

To make it clear there is no more than 20 people of less that can have this extra day issue. I can’t believe companies are being such wankers over this especially as a lot of us out more than contractual hours in

I have never thought I would have to do this during this time but if a company is in breach of tupe arrangements then I will happily go to my union to back me!!!!!

That’s a very good point. OP I’m sure you have posted work issues before. Maybe hold fire and see what’s the deal with it and why It’s happened.

Gosh people really do that ? Can’t you just tell your boss they are wrong and you’re taking an extra day off ? HR and unions should be busy doing much more important stuff

Unless you've signed a new contract of employment with the new employer for some reason eg new role/promotion, then your previous conditions of employment should be recognised. There are some specific exceptions eg pensions and options that aren't in the contracts. See what is said and take to the union if needs be. That's why they are there. It could well be whomever has said this isn't as read up on TUPE as they should be. Good luck.

What also I have found is that I went to my uncles funeral and could have taken that as berevment vacation rather than holiday but no one told me about that.

I wouldn’t mind but I actually send a copy of my contract to my hr team and said look it’s says 26 days and got told sorry this is a company wide adjustment.

The law is the law. Tupe guarantees your last working agreement, covid or not they are simply putting pressure on you and when others say things like unemployed etc that's exactly what the big companies and the government want you to be like scared fearful of what might happen so you we all just continue to get fucked over and over.

I think you have to be very careful given the current climate we are in atm.

I was also moved under a TUPE arrangement along with others, the new company seem to do what they like. We know that a consultation process should go ahead, as do they, before any changes are made but it hasn't happened yet after a year. No one would question them atm ~ we are scared that we'll lose our jobs.

I've come across contracts being harmonised but I've never heard of TUPE'd contracts having a time limit. That's definitely a good question for Acas or the Union.

Definitely down to company policy and there are some generous company’s out there but seems they are very few and far between now. A company I worked for gave paid leave for any funeral you attended, they even paid me when I took a week off when my doggie passed away, can’t see many doing that to be fair, it’s all about the money to be made now.

I’d be the first to say stick to your guns, far too many employees are far too nice and employers often take the mick. I’ve heard good things about ACAS but don’t know how well they are functioning during the crisis.

Having said that, I also say pick your battles, ie is this a hill you want to die on? It’s one day? Would it not be less stressful to take a sickie instead?
