A woman has been found guilty of outraging public decency and fined. The man admitted the offence at the time and was cautioned.

I dont think I can post the link but the first paragraph should get you there.

It was at midnight, consensual, doesnt seem like anyone else was around - waste of public resources? Valid prosecution? Serves them right for getting caught? Foolish for her not admitting it and getting a caution? Right for them to be publicly named? Any fabbers going to hand themselves in?

There's no need to be that harsh. The police could have just moved them on. Or waited till she was done and had a word. No harm done just jobs worth copers

We were caught in the car in a deserted car park at 2 am once . They drove up flashed there blue lights than sat opposite us for ten minuets and drove off . Think they was waiting fir a show but they didn't get one

If it was a member of public that might of seen got very offended, but those sort of people are tucked up in bed. Police was just being a nobber. If they where bothered they can move them on and leave it at that.x

I suspect the fact that she denied it and claimed to have been looking for her gloves may be connected to why they weren't just moved on.

Well I'm unsympathetic. That's the risk people take with outdoor sex. If they didn't want to be caught they should have just been adult enough to have enough self restraint to not fuck in the street.

Seems a bit odd that they would have been charged for OPD if no one else was around.

Criteria for an OPD charge are:

1.the act was of such a lewd character as to outrage public decency; this element constitutes the nature of the act, which has to be proved before the offence can be established, and

2. the act took place in a public place and must have been capable of being seen by two or more persons who were actually present, even if they did not actually see it.

So.... 'you were giving a blow job in the bushes in the park and those dog walkers over there could have seen you but didn't. You're knicked'

Which reminds me of the old adage - 'you don't get in trouble for breaking the law. Only for getting caught breaking the law'

If it's a regular dogging spot, it probably is on their beat. My local dogging spots are crawling with police these days. Fortunately I'm not a dogger.

I sometimes wonder how these cases get to court. I thought the public decency laws had to prove genuine risk of enraging /shocking a member of the public.

the police are the public also.

tbh the woman lied to the police and did not co-operate, that pisses them off more than anything so i'm not surprised they wasted their time charging her. the guy who admitted what he did only got a caution.

"Outraging public decency" is a pretty wide ranging offence that can be used for pretty much anything a police officer might want to apply a 'moral' judgement about.

OTOH I was under the impression that it had been held (on appeal) that one would not normally expect a police officer to be able to be "outraged" by public sexual activity. Some other member of public maybe but not a police officer.

The standard that normally applies for other offences (indecent exposure for instance) is that of "reasonable expectation of privacy".

However much of this depends on how police, CPS and magistrates attempt to apply it and how much the accused (victim) wants to pursue defending the case.

Not any more it doesn't... cases recently have held that it must "reasonable" that a person would be outraged and it has been held that police officers could not reasonably be expected to be outraged by a behaviour ie police officers are robust people, not easily shocked.

One time I was parked up with a girlfriend in the car park of a local sports club. We saw headlights coming down the long driveway to the car park so we stopped and had a look around. The car circled us a couple of times so I pulled my jeans on backwards, jumped in the front and started the car.

Then the blue lights flashed and they turned on a flood light and lit up the whole car. She was in the back screaming trying to cover herself up. A female office walked over so I wound down the window. She then said "We've had a lot of break ins here recently but that's obviously not what you're doing. Have a good night".

The best bit was catching a glimpse of the male officer laughing his head off as she got back in the police car

TBH the location they were at isn't that secluded. I don't think it's somewhere you could have a reasonable expectation of privacy. It's not like driving out into the woods in the middle of nowhere.

Not really - as is evidenced by the fact they were caught! Which means that either someone saw them and tipped off the police, or the police saw them when passing on a routine patrol which really shows how it's not a private place. It was a daft place to go and she was daft for not admitting it when he did.

I live just down the way from here and in fairness the police are always going to the lighthouse at all hours mainly for boy racers and the likes so I think that it was a silly place to play. I agree that the police should have looked over the other shoulder but they can't nowadays so unlucky!

she lied about what she did. she said she hadn't done anything sexual despite being seen doing that.

you always get a lesser sentence if you admit to what you did as it saves police time and also shows some level of responsibility for what you did.

probably wouldn't have even gone to court if she had admitted guilt and they'd both just have got a caution at the police station.

Don't you just love the daily mail - I reckon it's just jobs worth coopers. Name and shaming seems ridiculous. How is it even news worthy? Surely there's more pressing issues to be discussed, not someone having a bit of fun
