Criteria for an OPD charge are: 1.the act was of such a lewd character as to outrage public decency; this element constitutes the nature of the act, which has to be proved before the offence can be established, and 2. the act took place in a public place and must have been capable of being seen by two or more persons who were actually present, even if they did not actually see it. " the police are the public also. tbh the woman lied to the police and did not co-operate, that pisses them off more than anything so i'm not surprised they wasted their time charging her. the guy who admitted what he did only got a caution. | |||

The man admitted the offence at the time and was cautioned." "Outraging public decency" is a pretty wide ranging offence that can be used for pretty much anything a police officer might want to apply a 'moral' judgement about. OTOH I was under the impression that it had been held (on appeal) that one would not normally expect a police officer to be able to be "outraged" by public sexual activity. Some other member of public maybe but not a police officer. The standard that normally applies for other offences (indecent exposure for instance) is that of "reasonable expectation of privacy". However much of this depends on how police, CPS and magistrates attempt to apply it and how much the accused (victim) wants to pursue defending the case. | |||

Not any more it doesn't... cases recently have held that it must "reasonable" that a person would be outraged and it has been held that police officers could not reasonably be expected to be outraged by a behaviour ie police officers are robust people, not easily shocked. | |||

"TBH the location they were at isn't that secluded. I don't think it's somewhere you could have a reasonable expectation of privacy. It's not like driving out into the woods in the middle of nowhere." At midnight you should be okay in most places. We love outdoor fun.. and often have daytime fun but are careful and dont go outside during school holidays for obvious reasons. | |||

Which means that either someone saw them and tipped off the police, or the police saw them when passing on a routine patrol which really shows how it's not a private place. It was a daft place to go and she was daft for not admitting it when he did. | |||

"One time I was parked up with a girlfriend in the car park of a local sports club. We saw headlights coming down the long driveway to the car park so we stopped and had a look around. The car circled us a couple of times so I pulled my jeans on backwards, jumped in the front and started the car. Then the blue lights flashed and they turned on a flood light and lit up the whole car. She was in the back screaming trying to cover herself up. The fact that the man got away with a caution after accepting he did something wrong suggests to me she kicked up a fuss at the time." she lied about what she did. she said she hadn't done anything sexual despite being seen doing that. you always get a lesser sentence if you admit to what you did as it saves police time and also shows some level of responsibility for what you did. probably wouldn't have even gone to court if she had admitted guilt and they'd both just have got a caution at the police station. | |||
