All these Sydney University statements on profiles

By (user no longer on site) OP

I keep on seeing people with some variant of the following text on their profile:-

"WARNING:

Any institutions or individuals using this site or any of its associated sites for studies or projects - You DO NOT have permission to use any of my profile or pictures in any form or forum both current and future. If you have or do, it will be considered a violation of my privacy and will be subject to legal ramifications. It is recommended that other members post a similar notice to this or you may copy and paste this"

And I'm wondering, if it's used in a research paper, would you even know?

If you did know, what actual legal recourse would you have as I imagine taking a university on another continent to court might cost a bit...

I'm no legal eagle and I haven't read them, but there may well be a clause in the t's and c's of this site that allows your info to be used by third parties with fabswingers consent.

thoughts guys?

Legally those messages are rubbish and would not be taken seriously in a court of law. They are pointless.

I have a feeling this particualar university has done something bad with pictures from a site in the past...

All University staff and students must comply with the Copyright Act when using and creating copyright material.

Students and staff members of the University can be sued as individuals if they infringe copyright and may be held liable to pay damages and the legal costs of the other party. They may also be prosecuted for copyright infringement and be subject to fines and imprisonment in the case of severe infringements.

Under the Copyright Act, the University has a legal duty to ensure that its servers do not transmit or host material that infringes copyright. It may also be held liable for authorising copyright infringement, if it allows staff and students to infringe copyright using its equipment.

I've just done a quick google, I can't see any evidence (either news reports or blogs) of them being caught doing anything.

Must have taken out an injunction on the entire internet...

no one can claim infringement of privacy when they publish information on a public website, whether the site is members only or not.

I doubt very much if many of the people on the site have copywrited their photographs. It's not practical for companies to do it, so can't see individuals doing it.

There are hundreds of profiles that are very similar worded, have very similar coreagraphed photos, and have people who look very much alike and just maybe they could be mistaken for someone else.

It's hard enough trying to sue someone who's robbed your house, let alone who's copied a picture of your Jack and Danny

Putting the 'cum' in Eboracum

The FAQs on this site state that the disclaimers are useless and just take up space. I must admit I tend to roll my eyes when I see them as it seems a little bit sheeplike to copy and paste, but I've seen them on other sites too so there must have been something pretty terrible done in the past once upon a time.

Privacy has long been recognised as one of the important human rights and this is reflected in religion and history. There are, for example, references to privacy in the Qur'an, the Bible and Jewish law. Privacy was also protected in classical Greece and ancient China.

The protection of privacy is seen as a way of drawing the line to indicate how far society can intrude into a person's affairs. Privacy encompasses an individual's liberty to choose how they lead their lives, freedom from unwarranted state intervention and, increasingly, protection from invasion by the media.

An individual's privacy is highly valued. However, the law protecting a person's privacy is quite complex. The UK is party to various international human rights treaties which recognise the existence of a right to privacy, yet UK law does not contain a single enshrined right to privacy. No Act of Parliament creates such a right, and the common law only allows a limited recognition of privacy rights in specific situations.

I guess these messages on peoples profiles are akin to chain letters. One person tells another that they must have it to protect themselves, so to comply with their peers they place the message on their profile. In doing so they feel they belong to the collective of wisdom that has now protected their privacy.

If you want privacy, move to a desert island without the internet....

Why did you even bother posting this comment???

Did it add to the information being sought? Did it add to the general thread of the discusion or the general light feel of the thread? Nope!

And for that matter a quick search of this thread using good old eyeball mk.1 would have shown that I'd already done a search of the web for anything relating to Sydney Uni and hadn't found anything.

I've put my own version on my profile:

WARNING: Any institution or person using this site or any of its associated sites for study or projects - "crack on" you're only setting yourself up for failure by copying and pasting mostly fictitious information from a website. If this is all you have done, it will be considered a serious waste of your education and you'll just disappoint your parents. So knuckle down, do some proper work and stop being a drain on society. By the way, this site is not real its set up as 'red herring' to make you fail at your degree or research outcome.

"I doubt very much if many of the people on the site have copywrited their photographs. It's not practical for companies to do it, so can't see individuals doing it.

"

.

You dont have to 'copyright' them as such jackandkate, the copyright lies automatically with the person who took the photograph and their interest would be retained in the event of them challenging reproductions of their images elsewhere

i think the question should be what kind of research. It is a sign of an unquestioning mindset that is all too common. Why would they be using photos of BDSM and swinging sites ?

Secondly why would they identify the pictures, any data in academic research has to be anonymous for a variety of reasons.

didnt mean a serach of "the web" ... meant a search using "Search Forum Posts" up there in the top left corner of the forum page !!

... where you'll find many threads on this subject, and many more from the years of Fab

Quote from Admin (FAQ)

"We've noticed a legal disclaimer paragraph that some people have on their profiles. Should we have one too? What are they about? Do they do any good?

The "legal disclaimer" is pointless nonsense and all does is take up extra space on our servers. Please remove it if you have it on your profile. If you're worried about privacy please set your account to be hidden from non-registered users on your privacy page (this also hides it from search engines but may take a week or two to drop out of search) and remove the notice (and encourage others to do likewise).

Common sense advice would be NOT to put any information on your profile (here, or on any such site) that could identify you or that you don't want to become public! So for your own benefit, don't post phone numbers, real names or email / instant message addresses on your profile that people might see or "Google".

Some people may put non-identifying pics on their public profile but keep face pics private or for friends, for example."

"

And apart from that a lot of forums either have search as a "pay for" optional extra or don't have it at all. Or have it but it doesn't work.

Or the newbie might be posting from his phone and doesn't have the screen resolution to see the top of the page very often.

Here's a new one for you all:

WARNING:

Any couples or individuals using the Sydney University warning on this site or any of its associated sites have been sadly misinformed - You DO NOT have much legal redress should they use any of your profile or pictures in any form or forum both current and future. If they do , it will not really be considered a violation of your privacy and will be extremely unlikely to be subject to any legal ramifications. It is NOT recommended that other members post a similar notice to this as it's a waste of pixels.
