The laws where reformed and clarified, some due to new da laws and consent was re clarified. So yes basically from a male perspective, engaging in any sexual activity with a party who's consumed alcohol could lead to prosecution

What came out as the Ched Evans appeal is that a d*unk woman having sex does not necessarily mean there is no consent.

However the principle is and should be no one should have sex with another unless genuine consent is given. Intoxication prevents genuine consent.

In practice this means that a man who has sex with a woman who is d*unk (and not necessarily incable or comatose) risks being prosecuted for rape.

That includes in swinging clubs, in relationships and even if married.

If you're refering to the Ched Evans case, the laws were not 'reformed'. They are exactly the same as they were before.

However what the Ched Evans case *might* have taught us is that it's ok to have sex with women who don't consent, if you are brazen enough to go through the appeals procedure, using her sexual history against her...

no way! I don't drink at all now and haven't for years and I would only play sober anyway I want to know what I'm fully doing and in charge of what is going on and drink sometimes makes you do things that wouldn't do normally and that's not me! In Scotland we got the sexual offences act which moved rape (and other sexual offences) from a common law crime to a statutory one. It also made it a gender neutral law. Thankfully.

It also has a section about consent whilst under the influence of alcohol / drugs

Don't know maybe I'm misunderstanding you all on the definition of "d*unk" or maybe I'm on a different planet. Maybe both!

I have had a few times when I was really really "d*unk" (= so d*unk to be not in one's senses) and things happened that I don't even remember. Yes, probably not the wisest thing to do but the blokes I was drinking with, I had already decided I wanted sex and so it was consensual in a manner of speaking. Maybe at the time I fucked, I wasn't in my senses but it was pleasure and consensual all in one. But agreed, since I was in a group there may well have been someone I would not have normally had sex with and perhaps those could be classified as "rape". Don't think so but I give you that. But honestly speaking, am I the only one here who's done that ?

The rest of the times (i.e., majority) "d*unk" means "tipsy" for me. Full control of my senses but tipsy nonetheless. I thought it was very common. Doubt anyone could force him or herself on a tipsy person and isn't having fun while tipsy normal at parties? Seems so from where I'm standing.
