photo disclaimers

1st question - curious as to what's happening at Sydney University that might cause this institution to steal people's photos. I'm guessing there's some sort of research project going on about swinging? Does anybody know?

2nd question (if there's anybody legally minded out there) - these disclaimers people put up to warn individuals and institutions not to use photos without permission. Are they actually legally binding? And does putting these disclaimers up really prevent photos being used without permission?

Just curious. We've taken the view, that if someone wants to take our photos, there's probably not much we can do to stop them, and we would probably never find out anyway, disclaimer or no disclaimer.

The answer your looking for is in the FAQ'S section

Other people may think that by posting the disclaimer, they are protected by some sort of law etc... but in fact it is the biggest load of bollocks on here.

If Sydney University is doing research its taking a darn long time .

I'm not legally minded but I'm willing to bet that even if that load of twaddle is legally binding there aren't many with the resources to risk pursuing a case.

Oh? I think quite often when people are new to this they want to take every precaution possible to protect themselves, they see other people with it on their profile and think it carries some weight. I'd say they're naive (we certainly were and had it on our profile briefly) but not gullible or not intellectually stretched.

We soon realised it was worthless and removed it but I don't think people are stupid to have it.

I'm sure most (if not all) folks who have these disclaimers have out it just because they saw it on someone else's profile.

It's as useful and effective as email disclaimers. I worked for one of the world's largest construction companies and they didn't use them. That's all I needed to know.

Even if they were legally effective, you'd need thousands of pounds to even get your case heard. Then again it must be true; it was on Facebook

It's like that status that people share on Fb "As of (insert date) I hereby......."

People see it, think they're protected if they put it on their page, so copy it.

It's just shite really.

Even when new I'd say it was pretty obvious that it was a complete crock of shite! But as you say maybe some people are more easily taken in

Have to admit, I've always assumed that people will help themselves to photos. Institutions maybe not, but I've always known that there is not that there's not a lot I can do to stop someone posting my stuff on Tumblr. The only way to keep your photos safe is not post them in the first place, if anybody's that worried.

I think it gives people a false sense of security if they have it on their profile but in reality anyone can take your pics and post them wherever they like...

If you don't want that to happen you can write on them or give them a watermark

And even the watermark can be removed if need be - very easily ! but the amount of porn available on the web .... why bother stealing a few pics from 2 dime swingers site.

So,you put your pictures on a site that anyone can see for free. Have you visited the profiles privacy settings? Did you tick the box to prevent them appearing on search engines and prevent viewing by none members? Thought not. So you put a disclaimer on your profile. If someone is wanting to breach general copyright law do you think they will read your disclaimer? Most images are grabbed buy code called web scrapers.they do not read any text. So assuming your pictures turn up on another site, are you willing to pay a lawyer and spend many thousand of pounds and several years trying to win a case against someone trying to win a free pounds back? Thought not! Ps copyright exists in all my posts. Any infringement will be dealt with by severe spanking.

I still cringe slightly when I see these nonsense disclaimers on people's profiles. A quick Google search (other search engines are available) will bring up loads of proof that they aren't worth wasting the profile space on.

I keep seeing the one on here about Facebook being publicly traded too which means a complete copy and paste from elsewhere without even reading it. If the person who posted the damn thing hasn't read it, why would they expect anyone else to!

And i would doubt very much that a University would tollerate the filth a pornographic images on their servers. I don't know what it about but if you place an image on the internet, legally you have forfeited the right to own said material.

If you don't want it shared don't put it up.

Yes I wondered that. I suspect you are right, that by posting something on a public internet space, you are forfeiting your rights to that photo.

I don't understand why people have it. Even if they are new and naive and just following the crowd, surely they can think beyond that. Ask themselves the questions, what if my pics are copied, what am I going to do about it or stop anyone doing it, will I really seek a solicitor, issue a summons, go to court, how much will all of this cost etc. If all of that is unlikely and you won't do anything, why put it on there?
