British Naturism has a couple of publications, one for England and Wales and the other for Scotland, about the legality of nudity in public. You can download these for free from the BN website.

If you are not overlooked by the public but only by neighbours, you could try asking the neighbours if they mind. Invite them to join you

To my knowledge being naked in public isn't illegal, however, if public nudity is intended to cause "harassment", "alarm" or "distress", to "insult", or is associated with sexual activity an offence may be being committed.

If your neighbours can see in, have kids or don't want to see you naked you will need to be discreet. But if they have to get a ladder to see over your garden fence or hang out their window at a precarious angle then it is them in the wrong not you

If people try to see you naked when you have a reasonable expectation of privacy, then they are committing an offence.

Hence the "them in the wrong not you" bit."

But as it's specifically a criminal offence of voyeurism (introduced by the Sexual Offences Act 2003) you can report them to the police.

By the way, when the Labour government first introduced its sexual offences bill it was so sloppily drawn it could have criminalised all naturism in public. Many naturists successfully campaigned to remove those provisions from the bill, which is why nudity is illegal under that Act (England and Wales) only if you intend to harassment, alarm or distress. (However, the Tories have introduced other legislation since that complicates the matter.)

It's not illegal to go topless anywhere, although people can complain about it and ask you to cover up coz your tits are dangerous and scary or something...

I asked about the naked gardening before and apparently if nobody can see you, or at least nobody complains, then you should be alright (although it is illegal).

I'm a great believer of an Englishman and his castle, in other words you should be able to do as you wish in your home and garden.

Working as a gardener, I know for a fact people sunbathe and sometimes work topless or totally nude. I think, provided you aren't setting out to cause offence, ie, legs spread facing your neighbours bedroom, then you are ok.

I seem to remember that its not a criminal offence, but if someone was offended then you may get a visit from the council rather than the police. But I'm not 100% sure. Most people would ignore you, those that might not would be offended at anything, anyway!

Give it a go. It's your garden! My view is that to see you, they have to be looking into YOUR garden!

There's no law in England about being naked.

The law is about causing offence.

So you'd be breaking the law either

a) Being naked where you'd likely be seen by people who might reasonably be offended.

b) You deliberated spyed on someone who was naked in a place where they would reasonably expect not to be seen.

So for example, it's fine to cycle round a city centre totally nude with a load of other people on the World Naked Bike Ride (very good fun by the way, see me on youtube). Not illegal because all reasonable people think it's a good laugh and are not offended.

As for your garden, it all depends on who might be able to see you, and whether they might reasonably be offended.
