Are Swingers Clubs legal?

This may be a silly question but are they legal?

We`ve been to Chams and it was great, my wife and I were talking about this and wondered?

Most clubs are registered as Adult Saunas or Adult Health clubs. they are 100% legal but have to be registered.

Councils can still control thier opening but most councils that don't want them in thier area usually fall back on simple laws like parking facilities, noise etc rather than tackle the "sex" reason for refusing planning permission.

New laws have put a huge tax on all Adult establishments like lap dancing clubs, sex cinemas, gay saunas, swinging clubs etc.

Swingers clubs come under "private members clubs" and as such must charge for membership and a record of the name and address of anyone on the premises must be recorded at all times.

Interestingly Gay establishments have much more protection under the law than hetrosexual establishments, this is because the gay community took thier case for "the right for two adults to have sex together" to court and got a ruling to say it was legal. Laws were passed to say that they could (over the legal homosexual age limit etc)

Hetrosexuals never seemed to feel it necessary to take such legal action so no UK court has actually ruled on it with the exception of course of the legal age of consent.

I love the sign at chams which says that sexual behaviour of any sort will not be tollerated on the premesis.

Chams in Newport is only licenced as a gentleman's club. It is not licenced for females at all. Hence why it is men only sun mon tue wed thur friday daytime and saturday daytime friday nite sat night swinging only. So i suppose one day gwent council will have a go at em but not at the moment, darls is a proper club licenced for couples

And when the Equality Act 2010 comes into force on 1st October, private members clubs will no longer be allowed to discriminate with their entrance fees, they will be breaking the law if they don't charge single women the same as single men.

In view of the fact I can't see them dropping the entrance fee for blokes to the same as they currently charge single women, that'll be fun won't it, another hit to the pocket? I wonder how many women will feel like lashing out £30 ish to go to a club? It's bad enough already with the M to F ratios, looks like it'll get worse....

We used to belong to British Naturism. Some of them were really anti swinger clubs, and there was discussion on their forum about 'real' naturists going to swinger clubs then making protests inside, or even groups of naturists picketing clubs! Their attitude was that swinger clubs gave nudity a bad name, and had to be stopped. I have heard that some Muslims have the same outlook, but they object to people being nude together anywhere, even in private.

Nice to know that there are some prudish bigots around. I think they're just jealous, as they resent others getting lots of varied sex!

Has anyone checked the Scottish laws on it. Clubs have been in Edinburgh, Glasgow and Aberdeen for a few years and although they occasionally get raided, the police know they are there and they stay open???? Where do we stand?

There are mentions of raids on swing clubs on Fab. Unfortunately the search function doesn't allow them to be easily found.

Fetish clubs go through phases of getting attention from the cops.

You are correct to a point but a club may take what is called positive action where a certain part of the community's participation is disproportionately low I think we all agree and it's easy to prove that single girls are rare in the swinging club community positive action in this case would to be offer lower membership and entry free. Below is taken from the equality web site

If a service provider reasonably thinks that people sharing a certain protected characteristic suffer a disadvantage connected to that characteristic or have different needs, or if their participation in an activity is disproportionately low, a service provider can take any action (which would otherwise be discrimination against other people) which is a proportionate means of enabling or encouraging those people to overcome or minimise their disadvantage or to participate in activity.

it's not so much raided as the licencing people pop in when clubs are open to make sure it's operating within the limits prescribed..

I've been at a club when it's happened.. they do try to keep it low key.
