Hi this has nothing to do with swinging lol

Emma has more than likely got to have some opperations and planning ahead if worst was to happen what would happen to her son, she wants him to remain with me if worst was to happen rather than live with useless part time dad who in nearly 2 years has brought 1 pack of nappies sorry his brother did, has anyone had or any experience of getting parental responsablity for there step child

can you not legally adopt him,then write a will stating who she wants to be his legal guardian

Adoption very unlikely to happen if we tried as he would contest it same as he will parental responsability but courts should grant it which coupled with a will should be enough to keep him here,

Parental responsibility is fairly straight forward with or without his consent. If you are taking the responsibility of a parent then the court will see there is s need.

I'm sure you already are , but ensure you are visibly involved in sharing care. ie; be there in the school run etc when you can.

If the worst we're to happen and you found yourself alone then the court would look to see what's best for the child. They will look to maintain the status quo and weigh that against keeping your child with a natural parent.

Get legal advice and make sure you are jointly involved in his care. I hope this remains hypothetical.

It depends on when the child was born if it was before some time in 2003 all you have to do is print a form off the Internet (should be on the local council site) sign it and send it off. That will give you parental responsibility.

He can only contest it if he is actively in the child's life. But because the laws all changed in 2003 I would seek some legal advice your first hour is normally free anyway and should be able to get a rough idea of costs if you aren't confident to do it all yourself. Hope it doesn't come to it but good look with what ever happens to you both.

Sincerely hope that Emma's ops go well and there will be no need to worry about who cares for her son, but do seek legal advice - he's a lucky lad to have you in his life if his own dad is not there for him. Good luck to you all x
