Legalities of outdoor fun?

Ok so with the weather getting nicer and nicer with each passing day, I'm curious about something... Say you and a partner go somewhere outdoors that is way out of the way, on some nature trail deep in the country side or woods, and you see a fallen tree in an area of perfect privacy and isolation that is absolutely ideal to bend said partner over and fuck her brains out.

Now, lets just say a couple of plod are strolling along and stumble upon you both in this hypothetical scenario and catch you both red handed, are you actually breaking any laws and if you are, what sort of punishment are you looking at if there even is one?

Public indecency I'd imagine.

"Indecent exposure, if tried at a Crown Court, carries a maximum punishment of two years in prison. However, most indecent exposure cases are tried in Magistrate's Court, where the defendant will receive a summary conviction – carrying a maximum of six months in prison, a fine or both."

I may be wrong but it’s my understanding that there is no offence unless someone makes a complaint. Obviously this is so long as your well off the beaten track, away from public observation. Of course if your asked to get dressed and fuck off you must comply .

A serving officer gave me the information I mentioned previously. I said ‘ I may be wrong ‘ as he also said it is quite often down to the discretion of the officers involved

You are right, there is no law to say you can not have sex in a public place, however, if you do and are seen by someone that is offended by it, you have then broken a law under the public decency act.

This has been ‘discussed’ on here previously too

Just be careful, there were reports in my area that Police were not making arrests, however they were sending notices to the registered owner of a car that it had been spotted in a dogging site and further action would be taken if it was seen again.

The police have better things to do and who say because you are parked there you are dogging, they can not assume this.

Yes it's illegal, yes you're breaking the law, you don't even have to be in a public place for it to be an offence and it can be any member of the public who catches you and reports it, not just a police officer.

That's not quite accurate.

You are guilty of Outraging Public Decency if you commit a lewd act in a place where 2 or more people could see you. It does not require that anyone does actually see you, or that they complain.

There have been cases where no one saw the act, but the person filmed it for themselves, and they were subsequently convicted when the footage came to light.

Of course, there are plenty of defences. In the OPs case I would ask what were 2 police officers doing in the middle of a wood?

I have own a couple of fields and great to have sex in them, if anyone sees what goes on then they be trespassing on private property so their own fault if get offended

There are a number of laws that could result in an arrest, such as outraging public decency contrary to common law, behaviour that is likely to cause harassment, alarm or distress to other users contrary to the Public Order Act 1986, offences of exposure, and having sex in a public toilet - this is illegal.

In recent years though, police have adopted a softer approach and will probably only get involved if members of the public complain.

You are correct. Only an offence if someone complains to the police. Jeremy Vine covered this topic a couple of years ago on radio 2

Sorry to have to correct you, but I'm afraid that you are wrong.

There was a famous case (R v Hamilton) in which the police investigated a man suspected of a different crime. During the search they found several 'upskirt' images on his computer. He was subsequently prosecuted and convicted of Outraging Public Decency, despite that fact that no one had seen him doing it, and no one had complained.

So no, it's still an offence, even if no one is upset by it.

I guess at the time outraging public decency was the only thing they could prosecute him for. Thankfully "upskirting" has now been made illegal in its own right. I suspect the women whose photos he had on his computer would have been mighty upset

I was informed by a member of the police that it isn't illegal unless you Intentionally try to cause someone alarm or distress

I personally think if your away from prying eyes and off the beaten track you should be ok

That's "Exposure", s66 of the Sexual Offences Act 2003, and it requires the genitals to be exposed.

Outraging Public Decency is a common law offence, which means you have to trawl through all the case law to determine exactly what is, and isn't, a crime.

Speaking from experience if no one is around and it is unlikely someone will come across your antics then discretion will be used. Don’t go having a romp in broad daylight in plain sight in the local park - that would get your collar felt!

In my old force we turned a blind eye to local dogging spots because it typically prevented other more serious crimes such as serious drug dealing.
