The law specifically states that it’s if it’s witnessed and someone is caused offence.

Ahhh!!! Please don't use Google to inform your decision making when it comes to breaking the law.

It is illegal to perform a lewd, obscene or disgusting act that someone in a public place COULD witness it and be caused harassment, alarm and distress.

Technically, someone masturbating at a window of a house which is viewable from a public road meets this criteria, as does sex in a public place. The inside of the car is still a public place when parked in a public location.

The important element here is that you don't have to be seen by a member of the public, only that they could have done. If the police catch you they have a decision to make as a crime is being committed.

The police operate with discretion and can choose on the day how they punish someone for an offence. Generally speaking it will be to tell them to get on their way, sharpish, but you never know.

A person commits an offence of exposure if they intentionally flash with the intention of someone seeing them and causing distress- that’s why doggers go to dogging spots away from the public and with only consenting adults

outraging public decency is the one doggers are more likely to get done for

It's likely that if a dogging spot is mentioned openly on the internet, it's not safe. There are "known" locations but if you or I can read it, so can the police.

We have always considered well known dogging spots are exactly that. Well known. Not only by those partaking, but also by Police and boy racers “having a laugh”. For this reason we will always avoid such locations. Instead, we search likely spots on google maps/earth and even visit at the same time of day as play is planned to assess the likelihood of traffic/passers by/dog walkers etc. Once we are happy with a spot we arrange a “dogging type” meet here and invite people we have chatted with.

This way, discretion is as guaranteed as possible and if stranger sex is what you are looking for, invite guys from here that you have not met before.

May take something away from the old dogging craze, but less likely to suffer the embarrassment of caught.

I was aiming more towards dogging websites but appreciate they're also not safe from breaches.
