Is Swinging illegal?

Hi everyone,

Is Swinging illegal?....The reason I ask...?

I have just been chatting with a friend of mine who used to be on this site and he's recently just been betrayed by a 'friend' on here.

He was a youth athletics coach and had a page on here with all his pics private but someone on his friends list took screenshots, the pics never had full pics, either private area or face pics but they were only available to friends, and the unknown person anonymously sent the pics to the work place of the person who was in charge of his running club.

The person in charge then started threatening him that he would out him to his gf if he didn't step down, he eventually told her and they split up and he lost his Mrs and his kid, he screen shot every message and went to the police and they said they could certainly speak to the person doing this but then he went to his athletic governing body and they said they would deal with the the person but it turned out that after a discipline committee meeting against him they club said he was to leave his role, now they are making false allegations against him and he's not having his PVG approved to join a new athletic club.

So my question is, is swinging illegal?

Are they allowed to do that and dismiss him?

Should he contact the police again and go through with pressing charges against the person but that would run the risk of it coming out in a court and then ending up in the papers etc... further embarrassment to his ex gf and family....

What would you do?

Swinging is not illegal but as I've said many times before, if you're in any position involving young people you will be held much more accountable.

On the information given here I would take legal advice.

But fab is an adult website, not something kids have access to so why be looked at in such a way that he would be? They made it out as if he was a danger to kids just because he was on fab.....

It isn't illegal.

But some employers have a Morality Clause in their employment contract. And I'm guessing anyone in a job, either paid or voluntary, with children will probably fall foul of this.

But Admin take a very dim view of anyone threatening to 'out' another member to friends, family etc so for future reference report them to Admin.

Sounds awfully like a ‘asking for a friend’ post, either way, it’s a shitty thing for anyone to do, but if you work with kids, or you’re in that line of work, it’ll always be a tricky one to try and balance out. Remember the fireman that got dismissed for wanking in his uniform and posting it on his profile? Very much the same. Hope he gets it sorted!

Ignorance is widespread and many are against even minor variations from the norm.

Employment and professional bodies can define their own conduct rules. I believe that people should be free to have their rights to personal freedom outside of professional life, where they are not abusing their role.

In the good old days when we were in the EU, discrimination on the basis of sexuality would have ultimately led to the employer being taken to the European Court of Human Rights. There is no more reason a person should be discriminated against for being pansexual than gay or lesbian.

Guess we're in uncharted territory now.

Swinging is not illegal. What the one from his friends list did is. It's revealing private information with malicious intent. I know someone who got a criminal record for a similar thing.

As far as employment goes - need to check the contract and all applicable clauses that are listed in the contract or other documents/policies that form part of the contract very carefully.

Most common one is putting company into disrepute. Your friend wouldn't have fallen foul of it if there was nothing in the profile and pictures that would identify his employer, such as work uniform, logo, employer mentioned in the text, pictures taken at workplace etc.

Not sure about moral code clause mentioned by others. Like I said, the documents need to be checked very carefully.

If there is nothing that your friend has fallen foul off - he could sue the company for unfair dismissal.

As mentioned by other poster - your friend should seek legal advice for both cases - the person who outed him and the employment.

So, moral of the tale is to be careful what you post on the internet.

Consider non-identifiable pictures and text. Certainly no uniform pics..too many people have lost jobs because of that.

Agree with this, without any evidemce of 'foul play' or any kind if 'formal investigation' then it is constructive dismissal.

Get a solicitor involved, House Insurance usually give legal cover on employment.

An employer cannot discriminate or terminate on someones preferences or choiced -Sexual intimidation.

Further to this, the person who has done this could be liable for victimisation, harassment or intimidation of someones sexuality as well as invasion of the private life of and individual.

If financial loss has occured then possibly a claim for damages against them.
