I would argue that's it down to the individual unless the intent is to mislead eg someone indulges in mutual sex with another person knowing that it would be seen as cheating by their partner and decides that as its "not really sex" its OK.

The point I was drifting towards had nothing to do with fidelity, purely semantics.

Doing anything 'intimate' would clearly count as cheating, but pukka sex? Not so sure.
