Hey just wondering if anyone knows of the legal mumbo jumbo statement about Sydney university using pics etc has actually got any legal clout?

The reason I ask is because someone who is on the site (I don’t know who) has taken screenshots of all of our public pictures and sent them to my ex and she is now sending them to every Tom, Dick and Harry.

I have the police coming to see me soon, but just wondering if the following statements have any power

As I believe it if you post anything publicly on any domain you do so at your own risk. I'm not sure all that Sydney University stuff has any bearing on anything. I could be wrong tho.

If they are posting x rated photos of you, that is classed as revenge porn, there are laws to cover that.

The site FAQ specifically tells you about this:

We've noticed a legal disclaimer paragraph that some people have on their profiles. Should we have one too? What are they about? Do they do any good?

The "legal disclaimer" is pointless nonsense and all does is take up extra space on our servers. Please remove it if you have it on your profile. If you're worried about privacy please set your account to be hidden from non-registered users on your privacy page (this also hides it from search engines but may take a week or two to drop out of search) and remove the notice (and encourage others to do likewise).

Common sense advice would be NOT to put any information on your profile (here, or on any such site) that could identify you or that you don't want to become public! So for your own benefit, don't post phone numbers, real names or email / instant message addresses on your profile that people might see or "Google".

Some people may put non-identifying pics on their public profile but keep face pics private or for friends, for example.

Yes and also its not realistic even if you have a case, instructing lawyers (and a barrister's opinion) would cost a fortune..a fact that anyone you may be thinking of suing would very well know...

I'm pretty sure that pictures posted publicly online by the person in them would not fall under revenge porn laws.

It's not revenge porn they have used public pics it only comes revenge porn if it's a vidio or pic you took for personnel use then the other sent it public but even then unless you have a contract with stating that your snookered and be hard prosecute

Who in their right mind is going to actually take legal action?

Where do you institute proceedings if your pictures are hijacked by an overseas account holder?

Who is the action actually going to be aimed at....an anonymous profile?

If you want to remain discreet, are you not advertising your activities if you do?

Has anyone any proof that there are research students in Australia using their publicly accessible pictures and data?

If 8.1 ECHR is quoted, is it not overridden by the subject of the material putting the material into the public domain?

If 8.2 ECHR is quoted, the section does not apply as it relates to use of private material by a public body (ie. Government or Government sponsored), not misuse of pictures of bodies by some sad muppet with a small penis.

In short....it is a bollocks set of statements.

I think this Sydney university thing is a bit of a myth.

From what I've read over the years it seems that way back in the very distant past a few (a handful at best) students there did a study on the swinging lifestyle and did steal a few pics as a part of it.

However, that was pretty much it. Sydney university have absolutely no interest these days so the warning is irrelevant.

Your pictures automatically have copyright coverage without you doing a thing.

You can ask any web service to pull down a picture of yours (you have to prove it's yours BTW) and they should do so quite quickly. It's simply not in their interest not to. However, the difficulty is finding where the pics have propogated too across the web.

But that would probably only apply to the person who took the pictures off the site, further distribution could be said to be without knowledge of the origin.

Yes but that would be copyright theft, not revenge porn.

Either way they would have a case but the revenge porn texted I used was straight from gov.uk not a tabloid interpretation.

A little update.

Firstly thank you to everyone who took the time to reply/feedback

So we called the police and after many discussions it turns out some of you were correct. As this site is classed as a public domain, we post pictures at our own risk. So it turns out she hasn’t broke any laws. The only ways it becomes an offense is if someone receiving the screenshots from her is offended and makes an official complaint to the police which clearly won’t happen, or if she sends them to any of my family members.

I personally think this is a very Grey area in the justice system and needs a bit more work to protect people in this situation

I guess we live and learn and accept the damage is done. Our profile and pics will be hidden for some time now.
