Ex and his harassment

I need some advice. My ex is being a nightmare.

He has printed off my profile inc photos and verifications. I have removed them from his possession. He has accused me of theft.

Anyone know whether you can steal it?

My opinion is that you can’t steal something that doesn’t belong to another person in the first place. Ie my images belong to me.

Any opinions?

If you're after legal advice.

I'd contact a solicitor not ask on fab.

The theft issue can be a strange one when it comes to domestic issues. I had an ex refuse to return my belongings, was told by the police that it wasn't theft unless he tried to sell them

If you're that worried, get a new profile? New name, start over and don't have any pictures he can recognise.

Whatever you do, don't circulate the pics you have of him - remember that revenge porn is a criminal offence. If you feel his behaviour is causing undue stress, then maybe you should report it to the police, who at the very least should be able to verbally warn him about contacting or harassing you.

it doesnt just have to be distributed to be breaking the law.

him having your pictures without your permission is distressing and comes under the new revenge porn ruling.

It will mean that images posted to social networking sites such as Facebook and Twitter will be caught by the offence, as well as those that are shared via text message. Images shared via email, on a website or the distribution of physical copies will also be caught. Those convicted will face a maximum sentence of 2 years in prison.

The advice above is right in that he can be prosecuted if he shares the images with anyone - not just on social media and I believe if carries a sentence

But if he is harassing you in any other way you can get an injunction out against him and it will prevent him having any direct or indirect contact with you - this is an injunction served by the courts

You can go to any family solicitor to get this or go to NCDV and they will help and advise you

My (admittedly vague) understanding of the new law is that it's only illegal if the photos had an expectation of privacy? So if he has just copied pics that you have freely posted on your profile, even if he posts them elsewhere well that's shitty but not classed as revenge porn under the new law. Not sure if it may be classed as harrassment. As said before, proper legal advice would be best

Ignore it. If you have the images fine. If he goes to the police I don't think they are going to take his allegation of theft very seriously. He's got to prove ownership of them, which he had without your permission anyway. I'd just not give him any heads space over this matter.

Tell him if he thinks its theft to go to the police also point out that what he has done can carry a custodial sentence and is far worse. You have only taken pieces of paper and the police would take a dim view of why he took them as its potentially a bl*ckmail situation.

I would go to the police and register your concern, especially if you feel harassed or fear he may use information about your private sexual life to harm you. And yes holding on to images of him to use as a threat is exactly what he is doing to you. Be the better person and delete those images, using revenge porn can put you on the sexual offender register, thats for life.

Ask citizens advice where you stand legally. Then tell your ex to consult a solicitor and see how much he would charge to represent him should be bring a prosecution against you.

He's floundering about trying to scare you. No matter how afraid you feel appear outwardly calm and try to feel pity for his desperation.

Long answer short and please seek your own independant advise.

No you haven’t commited theft. The relevant part of the act being ‘dishonestly appropriate property belonging to another’

Whilst the pieces of paper may be his property, the images printed on them are of you, therefore you have a proprietory interest in them. The property does not soley belong to him and as a result you haven’t dishonestly appropriated them. Therefore no offence.

I’m sure the police would be more interested in his controlling behaviour and what he intended to do with said images and info.
