Porn uploaded without permission

This weekend, I recognised a girl from fab on a porn movie. I've not met the girl but she is pretty distinctive.

I messaged her to see if she was aware of this video - the video title itself mentioned fab, her name and the uploaders's fab name so she was able to find it quickly - but she was totally unaware he had done it. She asked him to remove it but he said no.

What rights does she have? What can she do?

Report in immediately, preferably to the police and if he has refused to remove it and/or she was unaware he had recorded it. Revenge porn legislation will cover it since April 2015. The Crown Prosecution Service issued guidance in October last year indicating that they could (and would) prosecute perpetrators of revenge porn under existing obscenity laws. Additionally, there is also scope for civil remedies under the Human Rights legislation, common law rights to privacy and the Protection from Harassment Act. The police and CPS take this very seriously

I've had two PMs from people wanting to see the video. This girl is distraught that someone has uploaded a video showing her face and showing her full name! So I don't think she would want anyone else seeing it...

Revenge porn laws are heavy now.

It's illegal to put up explicit videos online if the people have not consented nor have signed model releases to prove ages.

She should dmca the tube site immediately and report the case to the police with copies of all communication and full details of the man , destroy him and his life

Wankers right.

Why I really hate people wanting to film meets .

She could go to the police but she may not want to. The easiest is to contact the site it is on and ask them to remove it and they will do so. Has anyone seen the film Sextape?

Why people put themselves in this situation in the first place is beyond us, who lets a relative stranger film you? Really? Are people that stupid?

There is loads of fab swinger porn clips on the Internet don't know how many are genuine but bet half of them don't know the videos have been posted on the Internet it's big problem with filming meets with people you don't really know. But what these people posting don't quite get other than been totaly unloyal to the people they filmed with it could potentially land them in jail.

How do you know that she was aware she was being filmed?

The OP doesn't mention if she gave consent to be filmed but not for the vid to be shared/published.

She clearly knew she was being filmed, but I asked her if she knew it was online - and she had no idea.

A guy in this area has just been jailed for similar offences. I can understand why your friend might not want to go to the police but the law (on the face of the little information we have) is on her side.

Yes it looks like she gave consent to be filmed which in itself is pretty stupid xx hope she gets it taken down and the matter is dealt with properly x

We film with another couple because it's fun and we like to watch the footage later. We are not stupid and they are not strangers to us.

And your point is?

Guess she thought he could be trusted, you never know what will happen in the future, you may fall out! They may decide to put a video on a website, point is, anyone who has a naughty video of you could do anything with it and you have no control

Your question was whether people are really that stupid. My point is that it's not necessarily stupid. Like most things in swinging it's a calculated risk that enhances the enjoyment from the experience.

Yes she should go to the police, also send the site a DMCA (Copyright Protection) - DMCA Takedown Notice. which gives them 14 days to remove the material or face legal action.

We have battled for ages to get tube sites banned in the UK & we hope this year will be the year.
