Just wanted to share some stuff I was unaware of until receiving some child protection and safeguarding training a few days ago . Sexting ( the possession sending or encouragement of suggestive photographs, texts etc with a sexual nature of 16-18 year olds IS ILLEGAL. Although 16 is past the age of consent, the passing on of images is classed as child sexual abuse. The person in possession of these is classed as breaking the law.

I worry on here about younger meets/ contacts as although the age in here is strictly over 18's would it not be easy for a member who joins to lie and they could really be under 18? Just really scary. Be vigilant everyone... Xxxxxx

Wow thanks Seeteden your message is definitely thought provoking. I agree with the age thing and it makes it even worse when theres no face pic to help you deal with the age problem,

Yeah I really thought all this stuff needed publicising especially as there is a misconception that if a person is over 16 they are legally over the age if consent xx it's a grey area. Could get people into HUGE trouble which could cost them everything xx

What happens if the person you are messaging says that they are over 18 and you have no reason to suspect otherwise?

I have no idea whether it would be the case or not, but surely if someone is passing themselves off as over 18, then how could someone that was unaware of their true age be guilty of a crime.

I think in a court if law you are still responsible even if THEY lied. It's an extra safeguarding measure we should all take. You are the responsible adult just in much the same way as if you worked in a shop and sold alcohol to an under 18 who lied and was really under 18 you could be prosecuted. Do not take there word for it . It is not good enough.

I could be completely wrong here I'm not saying my interpretation is correct but maybe somebody who works in law can find this out for sure .

I just know it's a very grey area.

. it depends on whether the offense is classified as a 'strict liability offense'. those offenses classified as strict liability means that you cannot use ignorance or lack of intention to break the law as a defense. traffic laws are strict liability. if it's not classified as one, then you can argue based on the fact that intent to break the law and knowing what you were doing is/was wrong is actually what a lot of prosecutions hinge on. so, you could try to argue that you met them via an 18+ only site so therefore reasonably believed they were of an appropriate legal age, although without texts or emails to back up an attempt to verify the argument could go either way in a court.

Not to be too specific - but I knew a guy ( not in the town where I currently am ) who "pulled" a girl in a nightclub.

They went back to his place, and "had some fun" - whilst she was there - he took photos of her.

He is now on the sex offenders register, as even though he "pulled" in a nightclub, she was only 15!

Not only did they have sex, but he had images of her on his phone.

I personally think that is totally unjustified, but - thats the law and what happened to him.

Just to confirm in case people ask - there was no other types of photos with underage girls, just the one he pulled from a club.

This happens a lot. One of my cases at work got a 5 year prison term and is on the sex offenders register for life for the same thing.

We discussed with some friends a while ago about FAB having an age verification system, as we have been contacted by a few people whos quoted age didn't match the photos they posted and were definitely older. Something along the lines of the photo verification system, but with a picture of driving license.

If you're worried about privacy, all information other than the picture and date of birth could be obscured. Admin could then verify the year of birth on the profile.

This would work for those pretending to be older or younger than they really are.

Very easy to do this, was very close to this many years ago as when 23 pulled as they say in manchester, she told me was 18 as out with her much older sister and in a club, i spoke to her sister and she said she was 18 too!!

However when got her back to mine she fessed up was 16.

Wasn't happy she lied to me, so asked her to prove it, had no real ID so sent her home in a taxi.

We did end up going out for 3 years after that though as called me the next day to apologise etc and we met up.

good to know the law though on this though

If someone is intent on lying then they would probably just 'borrow' someone else's ID!

You can never assume anyone on this site or any other adult site is what they seem until you've met them. We're tending to do mainly club meets now and then only arrange meets with people we've met at clubs or socials.

Because it's a strict liability law - there's no defence available because of ignorance.
