Legality of dogging

Hey everyone

It’s something I’m drawn to but shy away from because I can’t afford to ‘get caught’ and potentially shamed. What is the law on this? Done my google research but still confused - does it depend on where you live and the local regs?

It is illegal and will breach public decency, indecent exposure laws etc. and this applies to anywhere public, not just at known dogging sites. Does it happen, of course so you just need to be aware of your surroundings and not aim to cause offence although this wouldn't be a defense in court.

It's only illegal if you're seen. Literally. To be an offence you'd have to actually be seen. Sex in public otherwise is actually legal.

Also, always remember, all crimes need evidence that proves guilt of an offence beyond reasonable doubt. One person saying I say so and so fucking by the closed down Woolworths isn't enough to convict.

I used to love dogging back in the day but did stop after the cops started patrolling the known dogging sites. I got stopped and asked what I was doing there talked my way out of it as nothing was going on at the time but did shit me up.

I would love to watch a couple again.

Yes I think it's obviously if you are caught or someone reports you.thats why most dogging happens at night time when there are less people about and no one who can be offended by what you are doing.the police do patrol known locations so it's always a risk I suppose

Im not a solicitor. However to me it seems a key part of this is intention or possibility of being seen by the public. So I would say factors like the space, time of day and business/footfall of a space maybe factors. I know when we enjoy sex outdoors we take great care in not being unwittingly seen for an ethical and legal basis. Considering most dogging is roadside or in car parks I would say thats a pretty public space by most peoples understanding and maybe hard to defend. So I would say on the whole dogging would find you foul of the law. This is why its key to do it with real sensitivity and simply not get caught.

I think in most parts of the country dogging really isn't a concern of the police unless its become an antisocial nuance to the public. And I think if a dogging spot is becoming a nuance to the public thats fair enough.

So basically don't have sex where you can be seen. And if you do get seen make sure its in a space where you can demonstrate you've gone out of your way not to be seen by anyone (which of course hopefully means that you won't have been seen anyway).

Interestingly enough, I was talking about this with an ex-barrister, recently, whilst we were both out cruising! Lol

He said that it’s illegal, if you get caught. Weird rule, as all law-breaking activities are illegal, if you get caught, but what makes dogging/cruising interesting is, police aren’t allowed to go out searching for people having sex, otherwise they’re the ones committing an offense: voyeurism. Apparently the location is very important. If it’s in a public car park in a country park, and the police turn up asking what you’re doing, you can just ask them to leave you alone, as it can be classed as harassment. However, if you’re in. Field, or otherwise private land, they can definitely come searching for you, and if they catch you, you can be busted for trespassing, AND indecency.

Just make sure that you’re somewhere you can see headlights coming, and you can zip yourself up quickly. As long as you aren’t engaging in any sexual activity at the time of being “caught”, they can’t do anything or pursue any criminal charges.

Oh, and, even if you do get caught with your pants down, it’s rare that they actually take it to court. It’s usually with a warning, and a bit of scare tactics.

As far as I know it’s the being seen part and therefore outraging public decency that is the illegal part. Having sex in public is not necessarily an offence. For example you and your partner drive to the end of a secluded, rarely used track in the woods at 11 pm and get on it. You have taken reasonable steps to expect a degree of privacy. Do the same in Asda car park at 4pm on a Saturday and it’s a reasonable expectation that you’ll get nicked….

This is why I posed the question in the first place! I’ve heard of a place where people meet where no one from the public would go at night. So in theory it’s safe. But if the police decided to check it out then to me that’s almost entrapment, and there’s no offence if there’s no one from the public around.

Appreciate the replies. Still sounds a bit hit or miss.

It's not illegal per-se. The ancillary offences of exposure, public decency and public of order only apply if it's being done somewhere where Joe Public is likely to stumble across it or if someone has complained.

In reality, the police aren't terribly interested unless a resident's group or local councillor is getting irate - and that's usually less about the dogging itself and more about people leaving a litter of condoms and wet wipes.

yes same here! Stopped over 25 years ago as police apparently had nothing better to do! There does not have to be a complaint from a member of the public now as police have more powers thanks to Tony Blair!! I wouldn't bother now!!
