Could anyone tell me where to find or the exact rule on people using photos with you in them without your permission, on the mobile site it states that they must not be able to be identified and you must have the other persons permission to use them, but on the non mobile site it just says you can upload pics with other people in as long as they cannot be identified.

Could anyone also point me in the direction of the full site rules as I cannot find them

From the "terms and conditions link" (bottom of page):-

5.8 In the case of those over 18 (or higher applicable age of consent), you should not publish or send any Content (including images) which enables those persons to be identified unless you have obtained their explicit written consent to the image / information being provided as well as to these T&Cs and our privacy policy.

Report the profile.

Copyright of a picture is with the subject of the picture not the photographer. So legally your image cannot be used witthout your permission. You can sue anyone using yor picture without your concent. Glad its been resolved

Any pics put up on websites become their copyrights i thought??? I could be wrong though?

Legally it is a bit of a minefield, and there is more crap talked than sense, but basically...

1/ If you take the picture, you own it, until such time as you do something to change that, see later items...

2/ If you are in public, there is no expectation of privacy, so generally speaking if you can look up and see sky, you can photograph anything you like... there are exceptions to this too, MOD sites etc

3/ if you enter into a legally enforceable agreement (see point 1) even if you did not read the small print, you are still bound by it, so for example any public profile pics uploaded to pof become both copyright and property of pof, if you don't like it, don't upload public pics

4/ anyone with any sense knows that the INSTANT anything digital leaves your own eminent domain, you just lost all control of it forever, it is the FOREVER that is the magic word.

sure, you may be happy today to have your face pic showing you playing hide the salami, but how about that pic surfacing in 20 years time? Hence some of is have a policy.

a/ no one but me ever takes a face pic of me in compromising situations

b/ no face pic of me that is not suitable to go on the side of the #7 bus ever leaves my domain, ever, under any circumstances, ever

c/ no "compromising" pics of me that are uploaded anywhere contain any identifying information, subject foreground or background

All of the above, in the play scene, is particularly hard to enforce in an age where smartphones will take HD video, and especially in group scenarios... ironically you are often safest in a nudist camp

bolting the stable door after a horse has bolted, and trying legal enforcement always brings the danger of the streisand effect (google it) so it is often best to grin and bear it and let it fad away.

just because THIS site may enforce such reported pictures, they are still out there.... I know of many, many, many instances where crap has ended up on xhamster etc without one of the participants knowledge or consent, by then it is too late and is all over the shop.
