Parking demand from smart parking

Got this letter from debt.company in relation.to parking.in Perth outwith.my time in...Wait for it...2014! Bit unnerving that as I can't recall even who was driving.my car back then!

Any advice on what to do?

Don't know if the rules are different in Scotland but in England fines have to be notified within a set time frame. I'm pretty sure that 3 years ago is too late.

They can take you to court but has to be worth their while as lady in Dundee found out recently

The lady in Dundee had mounted up a huge amount though, makimg it worth their while to follow it up legally. For a single one, bin it!

The law between England and Scotland is different.

You will have to be careful the Dundee case was a test case to see if these tickets were enforceable and they are apparently. However number of things you have to weigh up are you now getting this ticket because you've had before and ignored in 2014 can they prove you were there can they prove you were driver etc check online for new guidelines in how to deal with these the old guidelines weee unenforceable so throw in bin and don't correspond with them but after Dundee case may have changed

Ignore the Dundee case was exceptional for a number of reasons see website below. All private parking companies play on fear dont be suckered in.

The debt letter will be from a front company who is same company as smart parking read the small print.

This car park is always in paper for tryin to shaft people.

They must be rattling the trees one last time, I got one last week from 2015 as well for being over the free time allowed, this time its from a legal agent rather than the company, same postcode though, smile and wave boys, your getting hee haw.

Im currently ignoring one from a service station (didn't see any signs, no ticket machines anywhere), got my second letter from the debt recovery company this morning.

Got one last week from a shopping car park (genuine error on my part) and the time on that runs out on Tuesday. Not sure if I should pay that one while waiting to see the outcome of the first one.

I work in the Citizens Advice Bureau and we have been instructed to advise people to file it away in the nearest bin

The laws are different and it is enforceable however, they are not going to pursue you through courts costing a couple of grand for a £30 fine

Only the Local Authority or the Police will properly charge you for illegal parking

Just to clarify - by local authority you mean traffic wardens?

Traffic Wardens are employed usually by the Police however if like me you live in East Dunbartonshire that also includes their ASBO Community Wardens.

Like I said we at the CAB have. even instructed to inform people that unless the letter is from Police Scotland or your local Council then ignore it.

Pursuers of private car parks will not go to court over a £30 parking fine. It is financially not in their interests to do so.

These private companies are just that "PRIVATE" a money grabbing initiative from shopping centres, private landowners etc.

Unless it is a public road and the Council or Police have booked you then ignore the letters

You will receive approx 5 and the fine will increase but they are farting in the wind

If you park in a car park owned or being managed by a private company it's a non verbal contract you are entering into when you park. By parking your agreeing to abide by their terms and conditions. They are required to have several things in place such as signage at the entrance visible to the driver explaining that it's a private car park to allow you to make an informed choice. Your also allowed a period of grace if you overstay your time to allow you to get back to your car and exit. The British Parking Association has an approved code of practice on their website.

I got a ticket in Ayr a year ago I had paid to park and they claimed in had over stayed by 15 mins. The pictures were time stamped it took me 7 minutes to drive in park, register my phone and pay by phone which left me 8 minutes unpaid. The grace period paragraph in the BPA code of practice took care of that so I wrote the company a letter telling them I wasn't paying and explained why. I got a reply saying they had decided to cancel it. A small victory.

Motorway services are totally out of order for doing this...even when you're sat inside eating their grossly overpriced (and frequently shite) food, they've got their cameras all ready to relieve you of £50 if you stay one second over their time limit...which isn't long if you decide you want a few minutes in the car with your eyes closed, followed by something to eat (and something is usually a complimentary description, followed by a coffee before you leave.

The recommendation to everyone is, to avoid getting ripped-off completely, pull off the motorway at a junction that does NOT have a 'Services' attached, and get your fuel and food in a nearby town/village, for a vast saving to your wallet, and for food that's actually edible.
