If you're stuck in traffic and have a stop-start engine and the engine switches off, is it legal to use your phone?

Technically, you're parked with the engine off......

Illegal as you're still in charge of said vehicle. You'd have to be parked with handbrake on and ignition off (keys removed if not keyless start) and it's illegal to park in the outside lane of a motorway lol

But the ignition is still on with stop/start

I (sober)drove a guy home from the pub once and locked his car gave him the keys my mate picked me up and took me back to the pub. The next day he phoned me too say he was arrested after I left and charged with d*unk in charge of a motor vehicle as some one had seen us leave the pub and they went to registered address he had his keys in his pocket!!!!
