biscutes go soft as they go off cakes get hard as they go off so jaffa cakes are indeed a cake

Yep definately a cake. This is so sad that I know this but they don't charge VAT on it because it's a cake but they would have to if it was a biscuit

Heard the VAT bit before but why did it get through? Maybe because Sir Hector Laing Chair of United Biscuits who owned McVities was a close pal of Maggie Thatcher and donated to the Tories at the time? Just a wee guess

They are zero rated. The Government can then easily increase the VAT on cakes from zero % to any percentage if they so wish, if they were exempt then it is harder and a longer process for them to be able to do.

And to answer the point on how they managed to get them classified as cakes; they made a big version of a jaffa cake and proved that it went hard when stale, if it was a biscuit then it would have went soft instead!
