Apparently, common law is fucking amazing. It's purely based on common sense, it's not written down anywhere, and if a policeman believes that it has caused loss, harm, or damage, they can arrest someone.

A policeman thinks Brexit would cause loss, harm, or damage to the UK, they can arrest the entire government!

A policeman thinks that Scottish independence would harm the people of Scotland, they can arrest anyone suggesting it!

With this new found knowledge of how the law works, if you were a policeman, who would you arrest?

Haha! Great, I mean my common sense would say you can't, but your common sense would say you can. As we don't have any written source of law to consult, then I guess you could.

It's a serious business when government can't enable new legislation, we the people just choose the common law elements that serve us. It's the will of the people - not to mention that all important sovereignty that's enshrined somewhere or other: in common law, I assume.

If the entire government are to be arrested ....then so should the entire Labour Party as the official party policy is the same.

But if the policeman was a breciteer....would he arrest all the remainders?

But it's also only what the individuals choose to accept as law - it's like Woolies pick and mix, you help yourself only to what you fancy. Or something like, as I think I was educated on another thread. So there could be impasses, as the arresting officers and would-be detainees assert their rights. And they have to mention that they are a person, not a name, or something or other. It all got a bit legalese for me, as the finer points of the law aren't something that I'm particularly skilled in. Obviously senior judges would understand it very simply.

Probably citizen arrests would suffice, allowing the 'common' people to enable common law, in England and Wales, whilst in Scotland people could perhaps just make appropriate arrests.

I thought you, all of us, were just a 'person' and don't own our names. Ok, maybe the Queen does, but not the common people.

Not posh law, just common law. Given for all eternity as a right. We need that couple of legal experts again, to explain how we're able just to pick the law that we agree with and that our person is subject to.

I'm assuming UKIP types will just be happy to be put out of their misery, once arrested.

Don't you think it makes sense that on it's own a birth certificate doesn't act as evidence of identity, for example I could steal your birth certificate, go and commit a crime and wave your birth certificate and claim to be you, no questions asked. Also a FOI request confirms that the individual owns the certificate but the state own the record of birth.

I did. Are you going to keep on asking the question until you get the answer you want? No baby, at day 0 (Yes, when they are born is day zero) has the cognitive ability or experience to know what the date is, to ask what the date is, or to then keep count, day by day until they are an adult. Every one relies on records and their family to keep track of the day they were born. Happy Now?

How do we 'know' anything? State and private records are kept, as well as personal memories, the details of which can be passed on to others.

Generally it matters little to me when I was born - I'm not hung up on star signs etc. Official documentation, such as passports and service registration may require them, where you can input the officially recorded date of birth.

Back to the 'person' and accepting the common law, rather than any other laws, that have been passed as Acts, via parliamentary processes, after review etc.

As Jodie mentioned, if you keep quiet, not accepting anything, then you'll always have a clean record. Maybe a funny handshake could help too.
