Legal action on brexit.

You got to admire the passion the scots have, a group of scottish politicians want the eu court to rule on whether britain can halt process without other member states approval.

The court of session in edinburgh has said a legal action can go ahead to establish whether the uk can unilaterally stop the brexit process if british voters decide the final deal is unacceptable, what is your view? I agree with them

It's suggested that the process can be stopped but legal rulings rely on precedent, in many instances - no one has ever been this stupid before, so a likely ruling is required - it's particularly important as many UK countries voted against leaving

2 voted remain (Scotland and Northern Ireland) and 2 voted Leave (England and Wales). How individual countries in the UK voted really is irrelevant though as it was a UK wide vote and looking at the UK as a whole a majority of those who voted decided it was best to Leave, 52% and 17.4 million people.

The UK Supreme court also ruled last December in the Gina Miller court case that the devolved Parliaments in the different regions of the UK don't get a say in the matter as it was the UK Parliament in Westminster who took us into the EU in the 1970's and so now only the UK Parliament in Westminster can take us out.

For once you are totally correct however non of what you say has any relevance as to whether BREXIT can legally be stopped or as to whether a ruling on the issue can be obtained without parliament bringing the case.

Isn’t the main point here...,that the Edinburgh court of session doesn’t actually have UK wide jurisdiction..... let alone EU wide.

So will it actually count for anything either way?

Im assuming its a first step in getting it to the ECJ who will then make the final ruling.

Pretty clear which way the ECJ would go if it got that far....given that the EU commission, parliament and heads of state have all accepted brexit as a reality...and have now even given a final date for post transition full exit as December 2020!

The guy who wrote article 50 says it's reversible.

Gibraltar isn't a country - its a British Overseas Territory

After the EU sold Gibraltar down the river with Spain, Gibraltarians have changed their view entirely and are about as anti EU as you will find anywhere

He can say what he wants (btw he was British) but it’s only reversible (maybe) if ALL parties want it...and the EU clearly don’t!

I know he's British. It's not only reversible if all parties want it, its reversible if the ECJ says it.

Well not according to this article.

Gibraltarians' are maybe very pro-British but they also realise that their best and most secure way of staying British is by remaining part of the EU. The same can also be said for a large proportion, possibly even a majority, of the Unionist community in Northern Ireland.
