EHRC removes guidance

The EHRC has officially removed its interim guidance on single-sex services from its website (October 2025).

This follows sustained criticism and legal pressure, including:

- International human rights warnings:

Michael O’Flaherty, the Council of Europe’s Human Rights Commissioner, publicly cautioned that the guidance risked breaching Article 8 of the European Convention on Human Rights (the right to private life) in mid-2025.

- Legal challenges:

The Good Law Project initiated a legal challenge around June 2025, arguing the EHRC’s interim advice was unlawful. Many observers see the removal as a response to that pressure.

- NGOs and business resistance:

Organisations such as Stonewall condemned the guidance shortly after its publication. Many businesses declared it unworkable and refused to adopt it in their policies.

Guidance is not law

It must be emphasized: the EHRC’s interim guidance was never legally binding. It was an interpretation of existing law, not a statute.

Under the Equality Act 2010, trans people remain protected on the basis of gender reassignment. This protection does not depend on holding a Gender Recognition Certificate (GRC) or undergoing medical procedures.

This is good news although six months too late.

The EHRC is a bit of a joke and effectively directly controlled by the government.

It's worth noting that people often get EHRC and ECHR mixed up.
