It's just a good job that he's not the one making the decisions or putting the words in his own mouth. It's amazing to watch the people that are ACTUALLY pulling his strings coming and helping him off any stage that he manages to find his way on to. I heard that his approval rating is one of the lowest in history (circa 34%) so if he does win a second term then america is properly screwed. "I'm not sure age in years matters a great deal. There are plenty of over 80's who engage in regular strenuous physical exercise and are mentally acute. Although the thing about the Daniel penny case is that all of the arguments about that it is unjust are coming from those people outside NYC I mean… it’s hard to claim self defence or stand your ground if as all the other passengers in the subway car say that the victim didn’t actually touch anyone…. Therefore the action in choking him out was preemptive… “Just in case” and “he made people nervous” aren’t really great legal arguments…. Also… dude practiced MMA! The other issue against penny is that if in his marine training he was trained enough to apply the hold then he would have been trained enough to know when to release it… So the question is going to be how long the hold was applied.. if it was only 2-3 minutes he may skate… if it’s true what it being alleged that it was up to 15 minutes.. then he is in a whole world of trouble! | |||

"The only other thing I will say about the penny case is that he is lucky the charge is manslaughter and not murder…. But they were not. The other issue against penny is that if in his marine training he was trained enough to apply the hold then he would have been trained enough to know when to release it… So the question is going to be how long the hold was applied.. if it was only 2-3 minutes he may skate… if it’s true what it being alleged that it was up to 15 minutes.. then he is in a whole world of trouble!" I think this maybe the main point. Personally I don't think he'll have too much of a problem convincing a jury that he genuinely believed that his, or others, were in danger of death or serious harm. However he could fail on whether the amount of force he used in subduing and restraining was both reasonable and necessary. | |||

In all other areas equality between non-nationals and citizens is the constitutional rule. In sort whereas, under US constitutional law, foreigners do not have the right to vote in US elections, because they are not citizens, they quite definitely have the right to comment and say, as persons, in exactly the same way as any US citizen. | |||
