" As far as I am aware it is a criminal offence to issue false details on a County Court summons ignoring the fact that the small claims procedure cannot be used for a defamation claim. | |||

" Had the plaintiff used the correct procedure she would either have sought legal advice or used the correct forms . Any solicitor would have simply laughed at her for even considering issuing procedures against the prime minister . Her other option would have been to use the correct forms which is a more expensive and time consuming process. Did she send a letter to Boris first advising as to why she thought she was defamed and how she calculated the amount owing. Such a letter would be sent recorded delivery. She would also need to prepare pleadings. Her action would simply have been struck off at the first stage as an abuse of the process and she might have ended up with a costs order against her . | |||

I know from personal experience how you can get a CCJ against you for something you didn't owe or even know about. It took a couple of months to sort out but I got it removed from the court actions and my credit history. Pain in the arse but I suppose its just one of them things that can happen to anyone if enough people fuck up enough | |||
