He might be. Certainly, if he was diagnosed as mentally ill, it would delay any litigation against him, wouldn't it?

If he isn't, he will do once the new POTUS has U.S. Treasury agents crawling all over him, and his family and acolytes, in a thorough investigation of any alleged financial misbehaviour in office.

Given how hard Trump went after Biden's son, it's not difficult to see him wanting to return the favour; in the interests of balance.
