No, they are not taking us ti court!

They have issued a "formal notice" to the UK Goverment, asking for their observations on the matter.

This is only the very first stage of legal proceedings. Go to Court is the very last part of this procedure, and will take years to do.

Is this all part of the Brexit master plan,?renege on a previous deal , try and break international law? I thought this was going to be so easy? what is happening? I wish this could have been predicted

There are over 800 open cases currently against member states, 40 some odd cases against Germany and over 30 against France,so looks like we are just joining the rest of the crowd.

European Court of Justice is tasked with interpreting EU law and ensuring its equal application across all EU member states under Article 263 of the Treaty of the Functioning of the European Union.

The UK is not a member state so I would imagine has no Jurisdiction?

How would it be impartial if all the judges are from member states?

Quite simply, its about the integrity of the UK. In order to get his oven ready deal, Boris signed an international agreement that would mean putting checks on some goods moving between the British mainland and Northern Ireland. Now he has stated that he doesn't intend to honour that part of the agreement. The EU initiation of legal proceedings is not really the main issue here. The issue is rather one of integrity and if we will not honour one agreement why should anyone in future trust us as in any future negotiations.

The EU are trying to get the UK to honour the WA that they have already agreed to . You can spin it all you like, the fact remains that this a huge predictable mess that Boris could have avoided. When the bigger nations start trade negotiations with the UK they will use this against us, just like we would in the same situation .

It's not hard to get your head around UK and the EU were signatories to a joint legal documents, that we now want to break.

For the rest of Europe, it was the UK reneging on an international recently ratified agreement, endangering a peace process that saw the cessation of violence as a means to achieve political aims. Meanwhile in London, it was Thursday.

The UK is still a member albeit withdrawing over a long period so until we're actually withdrawn we are still subject to EU rules and regulations and any breach while withdrawing is still valid.

OK, OK to be totally 100% accurate...

The UK is no longer a member of the EU but to smooth lol... To smooth our exit we are still paying to have all the benefits of being a member until the end of 2020 through the withdrawal agreement. By doing so we are still bound by all the rules and regulations that a member state has to abide by until Jan 1st 2021 and any breach of the rules before that date can have action brought against us even after the withdrawal agreement date has passed.

This whole thing is just about honesty. Regardless of the detail of the exact nature of the proposed infringement, whether the terms have been broken yet, or what court might be involved in any case - the fact is that just a few months ago Boris Johnson on behalf of the British government signed an international treaty, a contract, that he had been largely responsible for putting together. And now the same Boris Johnson has put in front of the same British government a request to pass a law which openly states that he intends to break the terms of that treaty. Which states that he regards agreed contractual terms as something that he can unilaterally alter after the fact.

Whether the UK will actually break the contract, and exactly what penalty can actually be imposed for breaking the contract, does not matter. All that matters is that the head of the British government is saying out loud in front of the world "England does not keep its promises. England is not honest. England has no intention of abiding by any agreement which it makes."

And poof! All those wonderful trade deals that were promised after brexit have vanished. Why should any country ever again sign a deal with the Johnson government, when the Johnson government has just shouted out to the world that it is a deal breaking government, a dishonest government, a dishonourable government. A government that can never again be trusted.

They are not honest dealers and cannot be trusted to abide by ANY future contract they sign. 2. They actually do not understand the concepts of honesty, truth, honour, acting in good faith.

So why would any country ever again wish to come to any trade arrangement with England, when they absolutely know now that Johnson's signature on that deal is in fact totally worthless? It doesn't make us strong in talks, it isn't any shrewd negotiating tactic, it merely trashes completely the reputation of this country.

I had a quick look into this trans Pacific trading block a few weeks ago when the Japanese deal went through. I did not appreciate just how big it was and wrongly assumed given our location on the map we would not qualify but turns out we do.

You should ask the EU because clearly they think it does. I assume it’s pretty easy to understand that a country doesn’t want another country in the vicinity undercutting them with lower standards or subsidised industries. It makes perfect sense. But hey, if the brexiters decide that the EU shouldn’t have a problem with this, who are the EU to tell us otherwise? How dare 27 countries resist the whims of Little England.

Exactly now you understand ,they do not want the competition they know the uk will do well after we leave and that they have been holding the uk back.So why knowing that do you still say we will be worse off?

Distance clearly does not matter as the USA example shows. The EU use the location excuse when asked for a Canada style deal.
