Apple and the EU

News comes that the EU Commision has lost its case against Apple.

They had claimed that Apple had been given preferential tax rates in Ireland, and in doing so, had avoided some 13 billion Euros in tax.

The EU General Court found in Apple's favour, which means that Ireland will not receive the above sum. Which in anyone's language, would have been a tidy revenue contribution.

The EU Commision could yet appeal to the EU Supreme Court.

The eu trying to clamp down on this was mentioned in another thread.

Fairly sure it was nothing to do with our decision to leave

If we had “lost” the case

We would have been “awarded” the €14.5bn and then awaited a sea of claims from the other 26 plus the uk making the argument rightfully,that the tax should be rebated back to country in which the sale originated.

Ireland inc would probably then be entitled to around €300m gross not including the amount that would have to be spent on legal fees dealing with the various claims from the other EU countries,bad blood between neighbors,our reputational damage in terms of FDI and upheaval in our corporation tax regime.

The only regret I’d have is that we didn’t lodge it somewhere we could claim interest on it for the duration of the case as opposed to an escrow account

God people are talking some sh*te here.

This was to do with a deal between the Irish

Government & Apple to Build the biggest data centre

For Apple outside of the.U.S & China.

The tax sweetner deal was very underhand but

Almost lead to a massive boost for the country

In terms of jobs.

A billion pound investment was lost .

It started over planning challenges &

then it became about tax .

"Europe’s second-highest court ruled on Wednesday that the Republic did not give Apple illegal state aid, overturning a European Commission decision four years’ ago that the iPhone maker owed Revenue €13.1 billion in back taxes ".

I'm sure I read on the BBC earlier today it was in connection to Apple's HQ that existed on paper only. Apparently Ireland's tax regime was more attractive hence basing their theoretical HQ there. Surely Ireland must have been within the rules to allow it to happen given they have to answer to the EU

So one of the big global multi-national companies, that everyone wants to tax heavily, is still ahead of the game.

Paying tax at a rate of 0.05% and seemingly untouchable.
