"If you caught someone taking a picture of you without your approval would you: A) lean forward to give them a better cleavage shot? B) ignore it? C) tell them off and make them delete it? Someone took a cheeky pic of my cleavage on the train but they obviously didn’t realise their flash was on! I went with option C btw! " creep! Definitely C

"I knew a guy who used to take photos of women's bottoms in public places and post them on a fetish site. I tried in vain to explain that that really, really wasn't OK but he couldn't understand what he was doing wrong if they didn't know. But it isn't OK, is it? " No not at all!!!!!

"C This happened to me with some weird bloke years ago at a NYE party. My mates noticed (they knew him) the challenged him, took his camera and looked through. He'd got about 100 photos all of me. Lord knows why, bloody odd ball. They made him delete them and suggested he left (which he did)" Yiiiikes

I can entirely understand why someone might be distracted, but to take a photo? That just isn’t normal.

The law only applies to private property where you can reasonably expect privacy or if someone is attempting to take inappropriate photos (hence the recent new upskirting laws). Its not even illegal to photograph children which many don't realise. Anyone with common sense will always ask for consent (street photographers etc.) But if you damage anyone camera or phone it's you on the wrong side of the law. Even the police can't force someone to delete a photograph. A

"To the above poster although cleavage photography is not specifically mentioned in the Sexual Act or the added Voyeurism Act (this dealing with specific upskirting) it is still a grey area, as that individual is taking pictures without the other person’s consent and likely for sexual gratification. Everyone should be able to dress as they wish in public without being expected to be photographed without consent, especially travelling to and from your work " Yep. If someone is zooming in and deliberately taking a cleavage shot that's covered under the same law. The grey area would be someone taking a photo in a public place where someone happens to have cleavage on display. Happens all the time in bars, clubs and beaches. Intent is key but proving it is a legal minefield - as you say it's 'likely' to be the case but unless there's evidence (a file full of similar photos on a phone or laptop) to prove it it's not going to result in a conviction.
