A little bit of legal advice please

A young family member has just received a county court claim form through, asking for over £1500. They were involved an road traffic accident 18 months ago which they admitted liability, they were told by their insurance that it their insurance had paid out. They renewed their insurance with a different broker and told them about the claim and paying extra.

According to this county court claim it appears their insurance has only paid out half of the cost and they are being pursued and charged interest plus fees for the other half.

This is the first they have heard about it, they have no idea that only half was paid, and no idea they were being taken to court. How come their insurer has only paid half?

What should they do?

I will help them speak to their insurers tomorrow, but they have just opened the letter and of course the insurers are closed currently.

As a side note, they feel that the damage could not have come to nearly the amount stated on the documents, but there is no way of knowing what the actual cost to fix the damage would have been.

I would have thought it is the insurance company that would be being pursued rather that it being passed back to the driver as they were the ones who have only paid half the bill

Did he/ she have any excess on the insurance that he needed to pay but didn't?

They were only insured third party fire and theft. They did have an excess but I believe that would be for fire or theft.

They were never asked to pay any excess towards this in fact have not heard anything from the then current insurance company about this. They just let the new company that now that they had had an at fault claim.

On the paperwork, it is asking for the money to be sent to an insurance broker, not to the actual client of theirs.

If you are insured third party fire and theft and somebody claims against you do you pay the excess? I thought it would be only if you claim on your own insurance for the fire or theft part

Has the other party taken out a civil case against your relative?

There are so many scammers out there and along with the endless barrage of phone calls from claims hunters, it's a minefield.

Best place for reliable advice is Citizens Advice. They have sessions that solicitors give for no change, but you have to book them in advance. Good luck!

It looks like either they have, or the insurance of the other party has. I don't really understand why no or why my relatives insurance company did not pay the claim in for. We will call them tomorrow and the Citizens Advice Bureau. Many thanks for all the help so far.
