It has been technically illegal for quite a long time, falling under public decency laws. However, the ability to prosecute was hampered by the way that law was written. Now it has been specifically named as an offence in the hope that successful prosecution can be made more effective.

But it is a vile invasion of a person's privacy

It was also illegal under the Public Order Act, but now it is a specifically worded offence that can carry a greater penalty.
