Could Santa be arrested for Breaking and Entering

Not in the UK because "breaking and entering" is an American term. In UK its "burglary" and he does not meet the legal points to prove for that offence, and he doesnt cause criminal damage when he enters either as he is magic!

I said for me not on me. He’ll empty it in the usual spot and he never gets it in my hair.

Nope. No intent to steal, inflict GBH or cause damage. At worst he's a civil trespasser...However, if I find a man in a red suit in my house at two in the morning, it will not end well...
