"A mother has defended her son and refuses to take responsibility over the destruction of a statue at an art gallery.

Sarah Goodman was fined $132,000 (£100,277) after her son Troy knocked the Aphrodite di Kansas City off it’s pedestal.

He is seen on CCTV hugging the statue while his mother sat and chatted with other adults, failing to stop him from touching the art. It then fell onto him, damaging the statue’s arms and head."

Although i’m wondering why such an expensive work of art didn’t have anything around it to stop folk touching it!

I've been guilty of not being fully aware of what my children were doing 24/7. In environments such as art galleries I usually kept a sharp eye on them and used to explain that there was a time and a place for playing. However I'd want to know was this a gallery that encouraged interaction with the exhibits and how long had the parent taken their eye off the child for?

I think if youre taking kids to an art gallery you need to keep an eye on them. Very different to a soft play area. I do have some smypathy for her but if shes allowed her kid to go off unoticed whilst she chats then unfortunatley its an expensive lesson learned.

Parents need to take responsibility for their children while out. Chatting to a friend is not taking responsibility for your child when you are in a museum.

Hmmm, I’m not sure about this one. Was the mother neglectful? How many parents can honestly say that they watch their children every second of the time that they’re out? I sure as hell cant. You get distracted for one reason or another and that doesn’t make you neglectful.

The gallery will have insurance and they also have curators to ensure that no one does something like that. I’m not saying that the child is their responsibility, but the safety of the art is, does that make them neglectful?

No she shouldn’t have to pay, I’m fairly certain that she feels bad enough about the damage and her child being hurt as it is.

A couple of years ago, a small boy got crushed to death by a massive mirror in a shop in Bicester village. Nobody blamed the boy for fucking about, and nobody blamed the parents. Responsibility lies with the arty place to make sure it’s exhibits are safe and secure. So the parent wasn’t totally in control of their child, big deal! It’s not like she left them in an apartment and fucked off for dinner!!

Yes, kids are kids. They do stupid things, and parents deserve a break. At least she was trying to give them some culture and not sitting them in front of a PlayStation with a happy meal.

If you are going to have a $132,000 piece of art on display in a Community Centre then it needs to be inaccessible to the public, kids in particular.

BUT yes the parents are responsible for their childrens actions so they should pay for the repairs. I've never been able to keep an eye on my kids 100% of the time, but there are places where you do keep a closer watch on them and make sure they act correctly for their environment. I would have thought that this was one of those places.

OK I'm a bit of a pushy parent but even I can say we all have moments that lack concentration and don't watch our children 24:7

So personally I feel that the mother should be punished some how, possibly through compulsory parenting classes. But the museum shouldn't have something touchable that isn't secured or behind some type of safety barrier so for that reason the museum should suck it up and claim on the insurance

Not really. The child was responsible for knocking over an expensive status,statue got damaged. Parent not within whipping distance. Who was responsible?...

The dozy sods who thought it wasn't a great idea to make sure it couldn't get damaged,the child for climbing it or the parent.

My conclusion all three,but mainly the former for allowing it to happen in the first place.

The child didn't take a screwdriver to the statue, he was giving it a hug... quite sweet really! Unfortunately he knocked over.

Maybe the mother should have been paying more attention, maybe the gallery should have made the statue more secure.

If the child hadn't knocked the statue over a lot of people would have been cooing over the display of affection and praising the mother for having such a sweet child.

Typical insurance company trying to apportion blame so it can wriggle out of paying up. Put your pitchforks away!

Yes.

It would be no different if you were in a supermarket, car showroom etc.

Your job as a parent is to bring your children up accordingly to respect others property no matter where you are.

No amount of 'what about health and safety' should even be brought into the conversation.

The parents surely knew that taking a child to a museum would have items on display. And it's common knowledge and well common sense to not touch the exhibits.

Yes, the whiney woman was neglectful, who allows a child that young to wander around the rest of a community centre that's open to the public whilst at a wedding reception being held in one room?

The community center should also take partial responsibility as the statue was not securely displayed.

They should pay half each.

Pay the insurance premium of having it professionally repaired, yes.

The museum should also be forced to install better security around such valuable pieces if they don't want them damaged to protect them, and anyone it had the potential to fall on. The museum should have had appropriate guarding around the statue if it was so valuable and in a position to be easily knocked over.

Any venue that has high value stock within easy reach of a child, is no place to take them until they're old enough to understand they can't play with them.

The mom should have been paying more attention to what her child was doing. No, I'm not a pefect parent who watches their child every second, but I also sure as hell wouldn't take her somewhere with expensive and valuable items that can be easily reached or damaged and then leave her to her own devices.

They're all at fault.

It was a community center not a museum. They had the statue on loan from a local sculptor.

The family were at a wedding reception being held in one of the rooms there.

The stature was in the public lobby.

The mother was in the room at the reception, the child was roaming round the rest of the building alone.

After the statue fell another woman (a member of the public) checked the child was ok.

It took the mother a further 5 minutes to come out and see what all the fuss was about.

For those commenting on insurance, yes an insurance company would probably pay out. However, thaw mother has vicarious liability and they would seek to recover their outlay from her. The child is a minor in her care and she has failed in her to duty to adequately supervise the child. I would guess there are implied terms upon entry regarding damages also. That’s the interpretation of the law. My view? Yes the mother has been negligent and if the child knocked over eggs in Asda messing about the mother should play, the value is only an extrapolating of cost and no different.

The child didn't take a screwdriver to the statue, he was giving it a hug... quite sweet really! Unfortunately he knocked over.

Maybe the mother should have been paying more attention, maybe the gallery should have made the statue more secure.

If the child hadn't knocked the statue over a lot of people would have been cooing over the display of affection and praising the mother for having such a sweet child.

The child didn't take a screwdriver to the statue, he was giving it a hug... quite sweet really! Unfortunately he knocked over.

Insuers only generally pursue recoveries against those with the means to pay. Otherwise it's not worth the legal cost

And I would love to see you argue any vicarious liability matter here in UK or Irish Courts. It would in all probability be thrown out at a very early stage on the grounds of reasonableness.

All of which ignores the fact that you can't sue a minor and indeed your faith in the courts supporting this being the "failure of the mother's duty of care" is somewhat optimistic.

We were at my parents house one and I realized that it was a little too quiet. My niece's were doing jigsaws and watching telly and practicing their dance routines to take that when we left them to enjoy the sunshine and peace and quiet of the garden. When I went in to find out what the unnatural quiet was all about, they were in grandmas bedroom mixing all her expensive perfumes together

We decided to keep it as our little secret and grandma didn't seem to notice. We fessed up some year later and she pissed herself laughing

Why wasn’t it exhibited behind a screen or in a case ? How old was the child? . Yes mother may have been a tad negligent ,, but possible the museum may have contributed to that slightly . It’s a tough one ...... but I do think parents should be liable for their children’s poor behaviour,,,,, ie ,,, smashing bus shelters , graffiti,, litter ,,, etc etc .....

I can't remember - very young, 6 or something like that? It was a special gift from my ex, one of those big expensive powder puff boxes and I adored it!

We were at my parents house one and I realized that it was a little too quiet. My niece's were doing jigsaws and watching telly and practicing their dance routines to take that when we left them to enjoy the sunshine and peace and quiet of the garden. Sounds like they're trying to claim for the full value of the statue not just the repairs. If I damage your car and it costs £2,000 to repair, you can't hit me with a bill for the full value of the car.

If the statue isn't repairable and they bill her the full value, in essence, what they are saying is, you break, you buy! That's why she gets to keep the statue in that situation. I'm sure it's the last thing she would want though!

Yes the parent is totally responsible for her child . Not sure how they can implement the payment . Taken directly from income perhaps or a loan like a student loan with interest payment ? Means tested ? Are there signs like in some shops that say you pay if you break .

Did the gallery invite lots of kids and parents as a way to shift works of art that were overpriced and they couldn't find buyers for?

I can see that there's possibly some split responsibility here - the gallery for poor display settings and mum for not paying some attention. If it's the USA, you can kind of expect this. I'd still like to see a notice stating that all damage must be paid for.

She should also be birched for displaying such poor parenting skills. Her child should be placed into care because they are clearly not safe with such an horrendous mother. And they both should have life bans from visiting anything that is arty in any way.

Or......

The arty place claims on their insurance and we leave the mother and child alone, because at the end of the day, everyone’s kid has broke something somewhere by doing something they shouldn’t have while mum/dad weren’t watching.

They’d took their kid to an art exhibition. They can’t be that lazy. Health and safety in public access areas is far easier to get a win on than proving parental neglect.

I've given a friend and her kids a lift before. The kids were pissing about and distracting me while their mother said nothing. I told the kids to either stop messing about or I'd stop the car and they could get out because they were making it dangerous for everyone.

They stopped pissing about.

Child needs to be old enough to appreciate the art and not to touch it. There are plenty of museums and galleries that are interactive so take them there instead x
