They got off lightly. I had a case were they ended up owing for breaching planning £282k

You break the rules you suffer the consequences

Much as we loved the place, I have to agree but the Mails report reads like it was just a sleazy sex dungeon. Its always been primarily a naturist spa which just happened to have a dungeon available on site.

Also to bring dear Davids children into the story was completely unnecessary and pushing the bounds of privacy... disgusting journalism.

It wasn't a fine. Just the profit made in the year since they were told to close it down.

Hull

It was reported in a few other papers, not just the Daily Mail.

But whilst everyone has railed against that paper for their style of approach to the case, there appears to be somewhat ignorance of the base issue.

That is, the owners had received warnings and advice from the authorities. They failed to comply and have paid the price!

Failure to heed planning and similar laws at your peril can lead to consequences.

We are certainly not ignorant to the law. Of course they ran the risk of losing and there would always be fincial implications. I have no issue with that and feel certain Graham was aware too and fully expected the outcome.

Did you ever visit Kestrels? Reading the Daily Mails article would leave you believing they were running a sleazy sex dungeon where customers were stripped bare but for flip flops and indulged in kinky activity and that was it.

In reality the majority of Kestrels members were simply naturists, some of whom were also swingers, but by and large Kestrels was an adult naturist spa.

The property included two large sunbathing gardens, hot tubs and a large heated pool indoor with a glass house style cover that could be pushed back in warmer weather making it an outdoor pool. These were the facilities members went for and of course, it being an adult venue, there was opportunity for sex eitherin the dungeon area or one of the huts if you wanted some privacy.

That alone is not my issue with the Daily Mails reporting.

Anne was a silent partner, her late husband David had open the club with Graham 10 or 11 years ago. Sadly David died a few years ago and Anne was left with their children. There was absolutely no reason to have mentioned those children or how they are being educated. It is downright disrespectful to have done so. No possible gain could be made by including them in the report.

THAT is my issue.

Unfortunately this is the world we live in. The press will do anything to sensationalise a story but I agree children should be left out.

It should be said though that Abfabs came before kestrels and the venue has always been known as a swingers club be it day or night.

I know... but Kestrels was advertised as an adult naturist spa and it was Kestrels that were prosecuted. Not Abfab Parties. Abfabs has been closed as it shared the premises.

Ive no idea why? Perhaps a good job as they would have had more illgotten gains to pay back

I would partly agree with you re the kids.

However (according to the report) it was the defence lawyer who tried to use them as a way to mitigate payment. So it could be argued that by not mentioning something that was actually said in court the reporter would not be doing his job properly.

As for the place itself. Once the council had received complaints they had no other option than to take action.

The legal process had been exhausted and the place was still given a full year to close. Surely the owners must have realised that there was nowhere else to go and had they closed it in time they wouldn't have had a problem.

It's a pity that it had to close, and I'm sure if we were in the area we would have used the place.

Surprisingly enough for the DM most of the comments on the article were supportive of the club.
