Why is "upskirting" NOT a sexual offence?

on TV at the moment. a man who took a pic up a girls skirt without her permission cannot be charged as it is not a sexual offence.

very wrong in our opinion, what are your thoughts???

just watching it....of course it's an offence, it's been a crime for 10 years in scotland, shouldnt be too difficult to put it into law here...glad it's getting air time, i would have assumed it was already a crime...repulsive thing to do
