Help, lodger moved out and left her furniture

ST. AUSTELL, CORNWALL

I have asked her earlier this week to make arrangements to collect it, heard nothing back. I gave her a months notice to move out, she moved out on time three weeks ago. Has anyone been in a similar situation and what can I do to get rid of it? Notice was given due to underpaid rent, but she always had money for alcohol and tobacco, I ended up supporting us both. Thanks in advance. xx

Put it in writing with a deadline date, send a reminder nearer the date and possibly send it recorded so she can't argue she never got it.

Recorded delivery of 2 weeks notice whereby you will sell the goods and your also entitled to charge a storage fee if she does collect in that period

There won't be a defined time. If she disputes you selling it you need to prove tst you gave them reasonable time. Text, email and recorded delivery give her a month and then bin it and she'll struggle to justify not acting if she ever challenges you

You can give her whatever notice you feel is reasonable (and what a judge would agree is reasonable) for her to pay the outstanding debt otherwise you will sell the furniture to cover part or all of the debt and any losses you have suffered.

As you have already contacted her repeatedly, three days would be sufficient notice of intent.

28 days notice in writing allowing also 7 days for the letter to arrive unless you send it recorded delivery

Then dispose of the stuff

Serve an interferance with goods notice, stating that she has 14days to collect her goods or you will take ownership of the goods.

Send it recorded delivery so she has to sign for the letter, print off the proof she signed for it and a copy of the letter, staple it together and file it.

If she doesnt respond in writing within the 14 days, the goods are yours to do what you want with

OP Google the 'Right of Lien'.

You can keep the goods till h=she is paid up on the rent.

She won't do, so get a free half hour phone call with a solicitor and ask them what to put in the letter to her

Recorded delivery letter, with a schedule of the goods attached. Give 21 days notice for collection - with reasonable notice to you - after which they will be sold or otherwise disposed of, with monies collected retained by you for debts owed. Quote the law at the top of the letter.

Collate your evidence of the past debts from her and retain, alongside this letter.

There are many people who struggle for furniture, so burning it would be cruel - some charities will collect it.
