Car Park fines

Yes I've been hit with a charge notice.

Thing is the day in question I am sure I made two trips to the said car park about five hours apart, I went to the super market and am sure I came back later to watch a film however this notice only has me entering the car park and then leaving later.

Sadly I have nothing to back me up by way of receipts/cinema tickets now as it was a month ago...

Anyone else ever been hit like this and what did you do? Have a sneaking suspicion i am going to have to pay.

Go through appeal process, knowing you're more likely having to pay. Then just chin up and move on.

Just don't pay it simple, they have to prove in a court of law how they was out of pocket to issue you with the fine,

If it's from the council then a different issue, then pay it,

But you have a charge notice not a penalty notice, don't answer them at all

I agree with the post above mine

If it's from a private company don't pay it , there's no contract between you and them and they need to prove you've left them out of pocket

Council issued tickets need to be paid unfortunately

If it is a private company just ignore all letters and do not engage at all.

A Penalty Charge Notice is different from a Parking Charge Notice and they are not enforceable.

If its from one of those shopping complex 3rd party companies or motorway service stations you can easily fight it even if you don't have receipts. There are a lot of websites set up by lawyers which offer help and advice on fight it. I've had 2 and won both cases...One even threaten to send debt collectors round. Never happened. ..they wouldn't reply to my emails etc etc...but i had proof of sending them details and asking for their proof of the offence. Their signs are often obscurely post and small print...not something one looks for when driving into a busy carpark.

It would cost more to send debt collectors too than the fine they sent out.

Google the said company and look for advice on fighting it.

All good advice above - as a side thought if you purchased anything with a c_edit/debit card then bank statements etc will at least provide an element of proof - although obviously wouldn't necessarily prove you weren't there the whole time.

Not sure, but there are websites dedicated to these things. Check them thoroughly about your options.

PS remember it is not a fine, it is a 'contractual' payment for using their property longer than agreed...

Believe the ruling was they could only charge you are reasonable lost revenue ie how much the parking price would have being for the period.

That rings a bell. So in theory, you could offer them say £5, equivalent to the pay and display next door for that same period.

No its not a kink! Its a site with a forum. If these people are tricking you, they have likely done it before. And it'll be there,

I avoided a big fine for so called parking when I just paused for 40secs

Inform them you used the car park twice that day both times you were under the time limit and how long you were away from the car park.

If someone's going around entering the numbers onto a hand unit, it's their error.

If it's off an ANPR camera on entrance and exit some Ines read the report and igno_ed your out and back in, because it's not going to evilly miss in, out, in, out but it might of missed 1 out or in. Maybe.

Anyway it's data, about you, relevant to them trying to enforce a contractual agreement. For the princely sum of £10 you can ask for the data from that day between your times that they want to fine you for. In accordance with the data protection act of 1998.

When it shows you exiting earlier in the day, reentering or exit and re entry, ask for your tenner back.

Maybe be cheeky and bill em £25 for the hour (honestly people charge by the hour) it took you to do it. That's how much I charge for surveillance work.

If they have clear notice posted at the entrance you have ente_ed into a contractual agreement.

But if you fight it there will be a camera somewhere on you're route home that will have caught you're car but t it will take a lawyer to apply for the footage.

It might cost you more in the long run

Don't contact them.

Just bin the letters.

Eventually they will say you are going to court.

It's all BOLLOCKS.

The last 4 I had just went away after a while.

Only works with private companies

I had a ticket from 2010 which I have ignorned I was 11 mins late after the free two hours but I recently had a court letter

plenty of stuff on you tube on how to deal with these people ..personally i wdnt pay ..its not a criminal offence so dont worry about it
