They split the compensation from the costs as part of the settlement.

So you might be awarded 5p compensation, which you keep, and £3k costs, which they keep.

They won't take your case unless you're almost guaranteed to win though.

Generally, they will negotiate compensation PLUS CHARGES with the other party. So effectively the offer will be made knowing that they will have to pay additional charges too. Therefore the offer will be lower than if YOU were paying a fee but the net result will be about the same.

thank you everyone. i am being taken to the cleaners i think as i was offered £7500 and told i would get none of that??

Try to find someone to sue them. (No win, no Fee, obvs) But this time, read the small print carefully first...

I don't think anyone would give you 100% of the compensation with no fee. Unless you can find someone who will cover the costs from the other side...

It will usually still cost you something though.

We're currently undergoing a medical negligence case for our Son but still had to apply for legal aid so they could investigate his reports, MRI'S etc to work out if we have a case.

Only then will they decide whether we have a case to go forward on and if we win they will take the costs from the compensation. x

Whoops, just seen this. As someone else said though, you need to read the small print on what they'll take.

Win = fee = they'll take what they need to cover their costs whereas some will agree before hand that they'll take, say, 25% *no matter what the award, as they've accepted the risk of taking on your case.

Whoops, just seen this. As someone else said though, you need to read the small print on what they'll take.

Win = fee = they'll take what they need to cover their costs whereas some will agree before hand that they'll take, say, 25%.

If the contract you've signed doesn't specify that they cant take all the settlement in fees you are pretty much screwed.

Your only hope is to challange on the basis that they are supposed to act in your best interests and it would appear that they have acted in theirs.....but it's a slim chance.

You might be better off filing a comaint with the regulators on the basis that they didn't act in your best interest.

Without knowing the circumstances, it is impossible to say. The OP has been somewhat sparse with the details.

It would not seem to be "par for the course," though.
