Adultery is grounds for divorce. Does this mean that swinging is culturally immoral? By “culturally” I mean in the view of the majority of the people in the country, not in your personal view.

Anyway, I read the legal brief about a divorce case in a state in the US where the wife was arguing for divorce in grounds of adultery. She had a sex tape of her husband with another woman.

It turned out the wife was the videographer for the sex tape. The judge threw out the case because adultery in that state is mitigated by consent. So I'd need more context even if I believed in cultural relativism.

I'm not sure whether the majority of people class it as immoral, but it certainly sells papers.

Well we when got married we chose our own vows- something along the lines of honour and trust, be your friend and love you forever, rather than traditional vows of monogamy and obaying etc. We were already swingers when we got married and we wanted to make sure that our vows would be broken. To us it's not adultary if we know about it

My augment would be that swinging is consentual and agreed so it's not adultery adultery is cheating with another /others with out your partners consent ??? What do I know tho I'm a builder not a fling. Magistrate

You have to prove and have evidence of intercourse. My Ex tried to do me for adultery, he caught me mid fuck, BUT didn't have proof so he couldn't cite adultery, this would have meant I paid all costs if proven.

I also had no texts on my phone to prove it took place.
