Its it illegal to have sex outside?

I know you can have a stern bollocking of the police if your caught in a public place be it in a car or out of the car, but if you up a country lane middle of nowhere and your in the middle of sex and sods law copper drives past what are the chances of getting arrested?

If someone sees you and is offended then you can be arrested.

I'd expect if it was in the middle of nowhere and you had no chance of being seen then most coppers would turn a blind eye or just ask you to move on.

The offence is public indecency I think.

Can't be an offence if there is no one there.

Difficult to argue in a shop doorway as the chances that someone WOULD have seen you are pretty high.

Sex in public placesWhether you fancy getting jiggy in the woods, local park, or even your back garden, you're in legally murky waters. The Sexual Offences Act (2003) doesn't legislate specifically against sex in public places, but that doesn't make it legal.

Public order offences exist to guard against outraging taste and decency. There are distinctions in law about where you can get it on. Sex in private dwellings (such as your house) is fine, even if it's in your front room with the windows open. But public settings (like shagging in the supermarket aisle), funnily enough, aren't legal. "In public" means the conduct must happen in a place where there is a high possibility of at least two members of public possibly seeing it (thus the supermarket-shagging ban).

But sex in isolated places is technically OK, so long as you have a reasonable expectation of privacy - and, of course, you don't get spotted.

Another part of the Act to watch out for is trespassing with intent to commit a sexual offence. The Sexual Offences Act deems it illegal to trespass onto somebody else's property to get it on, any time day or night. This includes outdoor places as well as buildings.

Police will usually only act on a complaint from a third-party or witness. So, if you're not rumbled, your al fresco fumble should be fine. But be careful.

In those circumstances it'd probably be down to how good a mood the polis are in and how you respond to their questioning.

If you are discovered by other than the cops it'd probably be down to who they were.

A gang of 20 something mountain bikers and probably going to take a different attitude from a group of SAGA ramblers or the leader of the local under 12's pony club.

The arresting/cautioning Police Officer concerned can and will count as the member of the public who has taken offence to your behaviour.

He can be both the witness/the complainant and the arresting officer.

As some of our local doggers have found out recently.....

scant regard to getting caught and by whom.. as long as they get their leg over.

Outdoor sex is great.. Daytimes is actually better than night time as more enjoyable.. the sun, the light breeze.. but it does take common sense..

One thing I have noticed is how many places now make it nigh on impossible to drive a car up to.. you have to go wearing sensible shoes.. and not be afraid to climb over a few fences.

I would even go as far as to say that outdoors group fun in the sun, would be very high up on my to do list this year.
