Hi, just wondering if anyone new the legal implications for the following scenario -

Following separation with ex year or so ago I moved out of marital home. Fast forward to present day, financial settlement agreed by judge and marital home awarded to me and I have been given agreed date to receive keys. As I had not lived in the marital home am I liable for any household debt that may have been incurred by ex during time they remained in the property? For example if they did not pay any utility bills etc? It is noted in court documents that I moved out, so just wanted a idea of what I may be up against. if bills are in joint names - it's a joint debt. If bills are in a single name - then that person is responsible.

Example from a friend - his credit card but she was an additional cardholder. They seperated and then divorced. She knocked up £10k debit on the credit card, before he got her taken off the account and card returned - however he was the one who was responsible for the bill. He tried to recover the goods and she argued that they were for the benefit of their children.

No matter what - divorce is a complete shit storm, sometimes easier to just let things go as it isn't worth the hassle.

As others have said it depends on who's name the bills are in.

When I left marital home water rates 7 electric were in my name, at the time (stupidly) it never occurred to me change them, was too busy trying to sort out somewhere for myself and daughter to live. Fast forward 6 months, he moved out and left me to pay all the bills, there was nothing I could do as they were still in my name.

Best thing to do is act as if this was a new home you had just bought, on day of moving in, take all readings and get the name changed over to yours.

as sexyredhead says, its whos name the bills are in regardless of anything else.

when i split from my ex 9 years ago i ended up paying her gas bill that she ran up for 3 months cos was in my name even tho i wasnt there
