Redundancy overpayment

OK so bit of a boring post but need advice, I had my redundancy pay all on my p45 etc.. no actual paperwork with official figures just the p45 with the sum that went into my account. I thought it looked a bit more than expected so I rang payroll and she confirmed yes it is right... today I get a letter stating they made a mistake and overpaid me by 600 and I need to pay it back.. should I pay it or say no you made the mistake?

I think you have to pay it back although you could negotiate and pay it back but by bit.

Tell them you can only afford to pay it back at £1 a week.It's their mistake so make them wait for their money!!

If it had been a much bigger overpayment, you could have sent the company a postcard from Panama asking them directly...lol.

If I was paying my virgin media bill online and I typed in the wrong amount I'd be a bit pissed off if they said....oh well your mistake

Lol some posts are funny I still have the money in my savings so can pay it back in one go, I was just wondering where I stood as I rang them the day it went in to check and they still said yes, boohoo I don't want to pay it back , please don't make me

You have a legal requirement to return the money if you know you have been overpaid otherwise I believe it's an offence under the Theft Act

Legally you are obligated to pay it back. You could ask if you could pay it back in kind and send a pic of you in a posing pouch, etc

Intended to be tongue-in-cheek. Unfortunately you do have to pay it back. Legally and morally. I hope you find re-employment swiftly anyway.

Well I have just looked at the letter closely and it states I've only been paid 1 owed day of holiday when I'm actually owed 6 not half days? So now it's very muddled up because this would amount to around the 600 mark.. going to have to call them, fave the music

As I recall the law from 30 years ago, you have to pay it back unless you did not realize it was an overpayment and have spent it on day to day expenses. The law may have changed since then.

Offer to pay it back a bit at a time.

get them to confirm your holidays owing and if you match then looks like they have done it right - hope so x

You will have to pay it back, no option, you can request a re-payment plan but no matter how much you try to avoid, if they wish they will take you to court

Did you leave on good terms. I guess you need a good reference so I wouldn't spoil that.

I will tell you a good story about someone that overpaid us by £ 20000.00 once. Mrs N's husband was vile throughout her divorce. We tried to deal with it as best we could. Didn't return the diatribe of hate as there were kids involved and she limped towards the day of settlement with many many awful stepping stones along the way.

Anyway we couldn't believe it one day when the terms of settlement arrived when we saw that he had agreed to pay

£ 20K more than we thought he was going to. We thought, oh well he's seen the light and and is behaving in a reasonable way at last.

Anyway the day arrived for the decree absolute or whatever it is you call it arrived and the solicitor called to say the £ 20K cash in addition to other stuff had been deposited. However we just knew in our hearts he'd overpaid.

Sure enough that evening the shit hit the fan and he appeared on the end of the phone pleading with us to give him the money back. Apparently his solicitor had got the sums wrong and she had been overpaid. Oh gord we loved it. We said it was justice for all the horrible things he had done.

It was in black and white and signed and sealed by a solicitor. We lorded it a little and told him we weren't going to pay it back because of all the grief he'd given us and besides we just thought it was what he'd agreed to. Serve you right was our initial thing because we knew to be honest that we had him over an utter and complete barrel,

We did pay it back next day but it felt lovely just to make them squirm and beg for just 1 day after all they'd done to us. To be fair the guy has never really been horrible to me since and I think he learnt a huge lesson that day.

I guess the moral of the story is

"Every dog has his day"
