after a recent car crash, i am claiming for neck/back injuries, has anyone claimed and how much do you think im likely to get, ive been offered £1000 out of court settlement so far.

are they injured or are you just playing the system?

The reason I'm asking is the old whiplash claim always comes up whenever anyone has a bump, oh and 1k sounds about right from what I've heard when others have sued for injuries.

i hope you arent just playing the system and are properly injured and i dont mean a bit of a stiff neck. the more people claim the more it costs us all, i hate the claim culture.

I knocked into the back of a car on the m62... honestly barely a scratch on the car.. was my fault tho..

my company car... 3 passengers in other.. all 3 sued for neck injuries..

it depends how much the injury has cost you in lost work, medical bills etc shouldnt be more than that, it shouldnt be a way to make money

the big pay outs are from loss of earnings normally.

as for the neck and back claim there is no limit.

always turn down the 1st few offers.

but only if your genuine, bigger the claim more chance you will be watched by a PI from your ins company.

I woman ran into my mothers car the other month, minimal damage to both cars, exchanged details etc.

When she told them at work they all said...."oh claim, claim, claim" she was quite disgusted by thier attitudes! I love my Mum

Mrs R had a 4x4 hit the back of her car and had (and still is having) trouble with whiplash injuries! There is a scale of payouts that insurance companies have agreed to so that silly claims can't go through. The days of 10K for whiplash are long gone, I'm afraid!

Last year the figures we were told to expect were between £1400 and £2000 including lost wages and expenses (for Les). She got £1800. When I asked if it were possible to get more, they said we may do if we wanted to wait for an amount of years to see if it flared up again!

And don't expect to be able to turn down loads of offers! Normally only get the first offer and your solicitor will advise to either take or wait. If it is wait, he will try to get more but normally only the once.

£1000? No, but don't expect to get rich on it!

Not car related, but i had solicitors call me up saying i could get £25,000

didn't feel right to claim though so haven't pursued it

I got £1200 for a whiplash injury a few years ago when my car was hit from behind and I went into the car in front

I would'nt have persued a claim as after a while I was fine,it was my insurance company that did it all on my behalf I only had to go and see a doctor,I did'nt even realise I was covered for injuries

Personal injury is my field of expertise: the sum offered seems low, but it a lot of factors have to be taken into consideration. You may need an expert to say what your injuries are, and not all medical experts will give you the answer you expect.

Anything less than £1000 will mean your solicitors will not be able to recover their fees (or at least full fees) so it is in their interest as much as yours to keep it above that threshold.

In terms of injury the same needs to have effected you for at lest 6 weeks reach such a payout. In my experience 6-8 weeks is your baseline for c.£1000 - £1500.00

It's not a case of what the insurers want to pay but what the experts say and the actual injury. Someone may have got £10,000.00 but it would have bloody hurt.

As for compensation culture it is the insurers saying there is such a thing, no one else. They stir it up but people should be aware of their rights.

£1k sems a bit low but whiplash injury settlements vary widely due to the potential damage that can be done. Its down to the lawyer to get decent acurate medical reports & then assess it profesionallly.

And then dont forget other losses, like earnings, loss of car etc.

People now are more aware of their rights, hence more claims, but a minority abuse the system, and insurers cant always spot the abusers alas.

I was a passenger in a car wreck. No one injured, but cars written off.

Motoring club towed the car, then contacted me to sell a policy which would pay legal costs of a claim. No fee, but premium deducted from any settlement.

They wanted to sue the driver of my car, but I wouldn't pursue it as I didn't think she was to blame.

But what went on here? Motor club sold an insurance policy and pocketed commission. Insurance company sold a policy. Solicitors appointed got fees from the insurance company.

And the whole cost was paid by whoever they could pin the blame on.

Its not a claim culture, its the claim business.

Passenger in the car driving near Pontefract, coming up 4 years ago - we were hit from behind (on a fecking incline believe it or not) and lots of cars piled into the guy who hit us as everyone braked.

I had a fractured pelvis, broken scapula,broken ankle and shin. Had to have my liver repaired and other internal bleeding stopped. I was still having surgery 14 months on.

He was d*unk (3 in the afternoon) on his way to Glasgow, wife and family in car. lots of people injured in the other cars too. Our car was a write off.

His third offence - he was given 18 months and served 3. His insurance company tried to sue mine for his 'injuries'!!!

Its fucken insane!! Yes I got compensation.

It was and when I see people making claims as a matter of course because they're encouraged by personal injury companies to do so I think it makes a bit of a mockery of deserving cases. We all pay for it in the long run with increased premiums.

How serious your injuries are.

What physical evidence of injury there is… not just you saying ‘ouch’

How much they have impeded you.

What your job is.

What income you have lost.

What expenses you have incurred.

And how quickly you want the money.

Was in a crash a few years ago, hit from behind whilst waiting to enter a roundabout

No injuries but a fair bit of damage to my mates car which i was driving

The third parties insurance company phoned me the following day and asked if i was injured and was i making a claim

I said no to both as that was the truth,

They then went on to offer me £600 not to make a PI claim (which they paid within days)

(they arranged teh car repair and a courtesy car as well, excellent service from them)

Seems some insurers are doing this now to try and stop false PI claims

I was involved in a car accident, I had green lights on a dual carriageway and the driver coming the opposite way decided that the filter lights were green his side - so he drove straight across the dual carriageway in front of me. No where to go but into him, as I had cars on my inside and couldn't take evasive action. Wrote his BMW off for him.

Long story short - his insurance company and mine were the same - think stupid dog adverts. They tried to handle everything in-house, big mistake. In the end I had to implement my legal assistance option and so had one side of the company sue the other side! As the insurance company were paying for the solicitors to sue themselves, they advised the solicitors that the case had been settled, when it was still ongoing.

I got compensation for my whiplash and even now, 10 yrs on, my neck will stiffen up and be painful.

I agree with compensation being paid for injuries sustained, if genuine, but this sue society is just ridiculous. Because of all the false claims, the insurance premiums have increased dramatically over the last couple of years.

I actually work with Doctors who see accident claims. Each Doctor has their own way, time and method of seeing each patient. Talking about the bog standard whip lash injury here. One particular Doctor I work with is a Accident & Emergency Consultant. He sees (counting numbers as we speak) 89 in one day. He sees one every 5 mins and has no break at all in the day. He gets paid an average of £350 for each consultation, work that one out. I did and I was gobsmacked.

Anyhow on these sort of days I really have my eyes opened. The worse cases are the Taxi Drivers, apoligies to gen ones. But they turn up, turns out their cab was full at the time, with surprisingly enough all their family and friends.

Then there is the family of Tracksuits. Daddy Tracksuit, Mummy Tracksuit and Baby Tracksuits. Daddy Tracksuit turns to Mummy Tracksuit and says....now listen Kids, when you see the Doctor do everything Mum has told you. Because if this goes well we are off to Florida pmsl

Do I agree with all this, absolutely not. This has and will come to an end. Insurance Companies are already highlighting the hotspots of the UK to where all the claims are being made. It just penalises the genuine cases that do happen

I know this, a guy who worked for me was hit by a taxi in Liverpool, no one in the car, two days later we got a claim for whiplash for the four passengers in his taxi!! Google mapped all addresses and suprise suprise they all lived on the same street. I contacted their solicitor who told me it was my drivers word against theirs??? I told him there must be hundreds of cctv cameras in Liverpool and would persue the matter, hey presto he rang me back within half an hour to say there had been a mistake!!!!

I also rang the taxi licensing office for the area, luckily he told me insurance fraud was a pet hate of his and he would shut the taxi firm down if he could!!

People power working!!
