A debate is taking place on a forum about the merits of some product from Company X. You don’t own the product nor have you ever tried it. You have, however, owned another product from the company. It was cheap and didn’t perform as you expected. As a result, you post on the board this new product is a piece of junk and of low quality. You pop offline and think nothing else of it.

Two months later you get a notice in the mail. It is from the company with the forum. Company X has sued and the court has ordered the forum to turn over your profile information and your IP address. You have 10 days to appear in court to object or the forum will have to comply. Now you have a big problem.

Posting in a forum does not relieve from the threat of liability. For better or worse, you can still be sued for anything from character assassination to invasion of privacy to…well, anything that you can be sued for in the brick and mortar world. Laws in the physical world apply to the virtual world as well.

Ah, but what about anonymity? Well, you leave a trail when you post online. Many people assume that they will be okay as long as they don’t put their true name, address and whatever on the forum profile. Wrong. A company will sue the forum for your IP information. It is recorded when you sign up. They will then track backwards to the company controlling said IP and get a court order forcing the company to reveal who has the account.

You are probably thinking this is a lot of work to just find someone who posted something on a board. You’re right. However, many companies now take reputation management seriously. They have lawyers on staff whose sole job is to do this. Whether they bring 5 or 50 actions makes no major difference from a cost perspective. More and more companies will be taking this step as well in the future as they try to protect their reputation.

So, should you not post in forums? Of course not. You need to simply be careful. Truth is a defense to any defamation claim. If you wouldn’t say it in public, don’t say it on a forum.

Just a quick word on smarthide...... if they REALLY need to find you, they will. There is nothing you can do to prevent this, apart from perhaps switching MAC cards with someone elses comp lol!!! Dont forget to switch them back after tho.

Whirlpool forums founder Simon Wright, who is being sued by accounting software maker 2Clix Australia for publishing comments the company alleges are “false and malicious”, says the legal action affects all online discussion and even film reviews.

“A lot hangs in the balance here,” Mr Wright told NEWS.com.au.

“This goes beyond Whirlpool, or indeed communities in general.

“It affects the viability of all internet discussion, from blogs to product reviews on Amazon.

“What’s to stop movie distributors from threatening anyone who publishes a negative review of the latest film?”

Mr Wright said that the support from users has been “incredibly heartwarming” and demonstrates how much they appreciate participating in forums that facilitate “fair and reasonable” criticism.

He said that Whirlpool uses a range of measures to identify potentially problematic comments and there is a set of rules in place to regulate posts.

“Whirlpool’s forum operates on the basis that users post their comments without prior approval.

“We treat all complaints about posts seriously.”

Members of the Whirlpool forum have also been donating money to help pay the legal costs for Mr Wright, who set up the website to help internet users discuss problems with broadband services.

Legal case

2Clix Australia is suing Mr Wright for damages after two forum discussions about its products on the Whirlpool site.

According to a statement on the site, purportedly from 2Clix, the action was based on comments criticising its software and postings encouraging other Whirlpool members to avoid purchasing their products.

2Clix spokesman David Morgan said that he would not confirm that the “Statement of Claim” on the website was an exact copy of the court documents.

“There is a legal process underway (and) on our legal advice, we will be making no comment,” Mr Morgan said.

According to the document, 2Clix “quantifies its loss in income between January 2007 to July 2007 at approximately $150,000 per month”.

The document also said 2Clix would be seeking $150,000 in damages for the alleged “injurious falsehood”, the permanent removal of two forum threads discussing its software and legal costs to be paid by Mr Wright.

Whirlpool said it would be fighting the allegations in court.

“Whirlpool believes the action has no merit and will defend the matter vigorously, despite being a community website with little resources,” the company said.

The forum threads in question still appear online.

Users show their support

Since news of the court action was posted on the website last night, more than 1200 comments have been posted in support of Mr Wright – and many users have actually donated money to help with legal costs.

“(I’ve) donated $1254 via PayPal… $1 for each post I’ve made on (Whirlpool),” one user said.

“WP is the best forum of its type in the world and it would be a very sad day if that were put in jeopardy… I urge you to donate as much as you can.”

Another user who looked at every cash pledge made on the site calculated that at 10.30am (AEST) today, supporters had donated at least $3097.94 for legal costs.

“Amazing when you consider that these were only the amounts posted, not including those who didn’t post the amount, those who had posts deleted, and those yet to read and donate,” the user said.

Indeed, of course you may start topics on whatever you so choose. And likewise I will comment as and when I see fit.

I merely, and quite politely, asked if you had some evidence for what you had said. You have subsequently come up with a 2007 case from a foreign country, but had you looked a bit further into it, you would have discovered that nobody contributing to a forum was being sued, and the case against the forum owner was abandoned when the company that had started the litigation went bankrupt. They went bankrupt because their product was shite, and not only were the contributors to the forum pointing out the crap nature of the product, but by suing, the product owners thereby guaranteed wide publicity to the adverse comments.

It is highly unlikely a company will sue somebody for posting adverse comments - it's a self-destructive process.

I can read material on the internet, and no radio telescope needed. Millions of people are reading stuff on the web all the time, and all of them without a radio telescope. I'm just saying that if the Government wants to read our stuff, they are welcome to, they probably are anyway, but they won't be using a radio telescope. That's all.

ah yes, common knowledge, for example, the Earth is flat, lightning strikes its own reflection, etc, etc. There is nothing at Joddrell that will perform those tasks, it's completely the wrong technology. And I believe the US are not prevented by their own legislation from snooping on their own citizens, but I'm happy for you to prove me wrong by pointing me to that legislation.
